Expropriation will be easier. New regulations on CPK are already in force


The provisions amending the Act on the Central Communication Port have just entered into force.
The Act assumes, among others: the possibility of submitting an application for a building permit on the basis of immediate enforceability of the first instance decision. In January 2025, in the first instance, the Masovian Voivode issued a location decision for the construction of the airport. Filip Czernicki, president of CPK, explained in mid-October that this provision would allow the company to apply for a permit this year. He pointed out that in such a scenario, in 2026 – after obtaining the decision – the investment process could be started. — The first piling works will probably start in mid-2026; These will be soil reinforcements on the basis of which we will build the terminal, Filip Czernicki said then.
Expropriation under the CPK. What's changing?
The act is primarily intended to facilitate the process of expropriation and obtaining compensation by those expropriated, and also provides for advance payments of up to 85%. amount of compensation.

It introduces, among others: minimum deadline for handing over the property, which currently does not exist. The lack of such a deadline could lead to unfavorable situations for the expropriated people. Pursuant to the applicable act, the deadline for handing over the property cannot be shorter than: 120 days from the date when the location decision becomes final, or 120 days from the issuance of the compensation decision in the first instance, if the location decision is immediately enforceable.
The Act also sets a deadline for the voivode to determine the amount of compensation – 30 days from the date when the location decision became final, or 60 days from the date when the location decision was made immediately enforceable.
The amendment is also intended to make more people eligible to receive an advance payment on compensation. In addition to owners of real estate with buildings, these are now also owners of undeveloped real estate. A person entitled to compensation will be able to apply for an advance payment of 85%. compensation determined by the first instance authority. The advance payment will be paid within 30 days of submitting the application.
What should CPK look like? 34 million passengers per year
The CPK Program is to include, among others: a central airport, located between Warsaw and Łódź, and a high-speed rail system. The new airport is to be initially adapted to handle 34 million passengers per year and designed in such a way that it can be flexibly expanded in the long term, in line with the needs and market development forecasts.
According to the adopted schedule, the construction of the CPK airport in the Baranów, Wiskitki and Teresin communes is to begin in 2026. In 2031, the airport is to obtain the necessary certifications, and in 2032 it is to be put into operation along with the first section of HSR in Poland, Warsaw – CPK – Łódź. The estimated investment cost until 2032 is PLN 131.7 billion.
