In the Krasnoyarsk Territory, driver inattention “Lexus” led to litigation.
The prosecutor's office said that the accident occurred in the courtyard of house No. 53 on Shkolnaya Street in Nazarovo in July 2023. A pensioner was walking in the yard with her dog. At that moment, a Lexus NX200T was passing along the road. The driver did not give the pedestrian the right of way and ran over the animal.
The pensioner tried to protect the dog, but fell, received numerous bruises, a wound on her forehead and lost consciousness.
“At the emergency room she was given help and stitches were placed on her forehead, but the consequences of the accident turned out to be serious: her health deteriorated significantly, her eyesight decreased, and she required long-term treatment and medication. In addition, the pensioner was worried about her pet, who was limping and suffering from pain after the collision. The victim is a labor veteran, a child of war and fallen defenders of the Fatherland. Due to her advanced age and the serious consequences of the incident, the woman appealed to the prosecutor’s office with a request to protect her rights,” — told the prosecutor's office.
The prosecutor's office filed a claim for compensation for moral damage and reimbursement of treatment costs. The driver actively objected: she did not see the victim or the dog on a leash, and therefore drove past. Having learned from the traffic police officers that a woman and a dog had been injured, she apologized many times and already handed over 30 thousand rubles to the victim.
The court upheld the claim and awarded 100 thousand rubles in favor of the pensioner. The Supreme Court confirmed the legality of the decision. The execution of a judicial act is under the control of the prosecutor.
