The Polish Energy Storage Association estimates that changing the regulations on electricity storage is a step in the right direction, but further actions are needed. On Friday, the Parliament decided that the construction of an electricity storage facility with a capacity of up to 30 kWh will not require a building permit.


The initial government proposal in the draft amendment to the Construction Law referred to a capacity threshold of 20 kWh. During legislative work in the Sejm, it was increased to 30 kWh. The bill will now be considered by the Senate.
As PSME emphasized, leaving the threshold at 20 kWh would mean that almost all domestic and industrial energy storage facilities would be subject to a full, time-consuming administrative procedure for obtaining a building permit, identical to that for large energy investments.
“We are glad that the voice of the industry has been heard and that it has been possible to work on rational, safe solutions that support the development of modern energy in Poland. The adopted regulations are not fully satisfactory to us, but they constitute a kind of compromise in relation to the original project. We hope that subsequent amendments to the Construction Law will be an opportunity to improve the regulations for energy storage,” said Barbara Adamska, head of PSME.
As the Association reminded, typical home electricity storage installations have a capacity of 30 kWh. PSME also postulates further changes to the regulations, so for warehouses with a capacity of 30 to 120 kWh located in a building, and free-standing warehouses with a capacity of 30 to 300 kWh, there was only an obligation to report to the State Fire Service along with a simplified fire protection design and an electrical design prepared by an authorized designer, in addition to reporting the warehouse to the distribution network operator.
The Association also believes that for warehouses from 120 to 300 kWh in a building and from 300 to 4,000 kWh free-standing, there was a requirement for a construction notification with full design documentation and fire protection arrangements. from PSP.
