Stoica & Associations obtain the suspension of the execution of a fine applied by the Competition Council

The team of lawyers from Stoica & Asociaţii, consisting of Valeriu Stoica (Founding Partner), Dan-Răreş Răducanu (Senior Partner) and Oana Zama (Partner), managed, on September 4, 2025, to obtain the suspension of a fine applied by the Competition Council by Decision no. April 100/15, 2025. By this decision, a number of four companies were sanctioned contraventionally for the conclusion, between 2007-2019, of concerted agreements/practices of dividing the market by allocating customers and/or territories on the market for the treatment services and/or elimination of the waste resulting from medical activities.
After changing the shareholder, the new management of the applicant brought to the attention of the Competition Council the previous anti -competitive facts and provided the documents necessary to initiate the investigation that started about eight months from this moment. Although, according to the incident legislation, in such a case the immunity would have been imposed, the decision instituted for the applicant society a significant fine, both from the point of view of the amount and the effects it was to generate on the general economic situation of the sanctioned society. As a result of the solution pronounced on September 5, 2025 by the Bucharest Court of Appeal, the applicant company will no longer be obliged to pay the fine applied by the Decision of the Competition Council no. April 100/15, 2025, until the investigation of the action in the annulment of the same decision. The decision of the Bucharest Court of Appeal is enforceable and can be appealed within 5 days from the communication.
