Estimated revenues from the sale of emissions under the EU ETS emissions trading will amount to about PLN 20.5 billion in 2026 – according to the OSR of the version of the Ministry of Culture and National Heritage Act on the system of trading of greenhouse gas emissions (so -called ETS1) after arrangements. In 2027, these revenues are estimated at approx. PLN 18.4 billion.


In the OSR posted on the bill, the draft act indicated that the draft act would increase the NFOŚiGW funds for financing investments under the National Modernization Fund implementation system.
It was reminded that Poland in the period 2024–2030 has the option of receiving additional funds from sales 65,797,356 emission rights, which is 34.2 percent. additional pool of EU ETS (2.5 percent) permissions granted to 13 Beneficiaries of the Modernization Fund.
“As a consequence, under the National FM implementation system, an additional amount of funds from the sale of permissions in the years 2026–2030 may amount to PLN 15,929.699.660 at the assumptions adopted” – estimated in OSR, based, among others on Kobize forecasts.
The presented calculations show that estimated general annual revenues from the sale of emission rights will fall from approx. PLN 20.5 billion in 2026 to approx. PLN 18.4 billion in 2027, and then amount to approx. PLN 18.8 billion in 2028, approx. PLN 19.4 billion in 2029 and approx. PLN 18.4 billion in 2030.

It has been added that the draft act may also potentially increase the state budget revenues from administrative fines imposed on entities entering the EU ETS system, i.e. Żeglugowe.
As for the influence of the Act on the public finance sector presented in the OSR, the balance of total income and expenses in 2026-35 is negative and amounts to about -4.5 billion. At the first years from the entry into force of the changes, by 2030, this balance is positive and goes below zero only in 2031, when it is about -4.0 billion, but in the last year of this period, in 2035, it is only PLN -41 million.
At the end of April, the Ministry of Climate and Environment sent to inter -ministerial arrangements a draft amendment to the Act on the Emission Trade System for Emission of Gas Gas and some other acts (UC39). The Act is to implement the Polish law provisions arising from the provisions of the “Fit for 55” climate package. It is to be imposed, among others The obligation to allocate all revenues from the sale of emissions for climatic purposes, not 50 percent. As before.
New rules for the allocation of emission rights for installations covered by EU ETS are also planned; The Act planned by the Ministry of Culture and National Heritage will also introduce a mechanism of gradual reducing the allocation of free emissions for installations producing goods covered by the EU price adjustment mechanism on borders, including CO2 emissions.
The draft act will also introduce regulations regarding the inclusion of maritime transport in the ETS system, while for the first two years they will apply to transient, alleviated, the rules for settling emissions for shipping enterprises: it will be the obligation to settle 40 percent. verified issues reported for 2024 and 70 percent for 2025
