The High Court of Cassation and Justice (JCCJ) specifies that it did not order the increase of the increase for risk and neuropsychic overload and the one for maintaining the confidentiality that the judges benefit from. The specifications come after the deputy USR Claudiu Năsui stated that, in order to compensate the increase for harmful or dangerous conditions, the president of the High Court ordered the increase of the two mentioned increases.

“Both the amount of each increase separately and the limits set for their total amount are established by law and can be modified exclusively by a normative act of the force of the law. An alleged modification by an infralegal administrative act (respectively inferior to the law) is excluded, did not occur and did not have to occur, which should be produced to all the level that should be known. Today, ”says in a statement of the JCCJ.

ÎCCJ: Not the amount of the other bonuses has not been modified

The High Court claims that the order signed by the president of the court implements the provisions of GEO no.36/2025, regarding the modification of the amount of the increase for difficult, harmful and dangerous work conditions (from 1500 lei to 300 lei), without other changes regarding the amount of the other two increases or the maximum limit of the total amount of the allowance applicable.

“The negative singularization of the judges, under the conditions of a special concern manifested in these days by the public opinion on these aspects, only affects the independence and prestige of justice, especially in the context in which the judicial system will be called to solve the litigious states born in relation to such issues,” the CCJ said.

Without nominating the Năsui, the High Court requires politicians or dignitaries to be properly informed before launching criticisms of the functioning of some state institutions.

“Although the High Court fully recognizes the right of any citizen to critically examine any aspect regarding its activity, including financial ones, when statements are made by politicians or representatives of some state institutions, these statements should be based on complete, professional information and the knowledge of the legal mechanisms,” the legal mechanisms said.

Claudiu's accusations Năsui

USR deputy Claudiu Năsui, former Minister of Economy, said, in a Facebook post, that the High Court of Cassation and Justice ordered the reduction of the increase for harmful conditions to 300 lei, in accordance with the Government Emergency Ordinance, but increased the amount of the increase of neuropsychic request, so that the income, so that the income.

“The JCCJ has just ordered to decrease the increase of harmful conditions to 300 lei, but the salaries will not decrease. Why? Because the increase of neuropsychic and privacy increases so that the salaries actually do not decrease,” writes Claudiu Năsui.

He recalls that the current legislation limits the amount of the bonuses to 30% of the salary mass allocated to each state institution, so that the different bonuses have different amounts and proportions depending on the workplace.

According to a document published by Năsui, the CCCJ management limited the increase for harmful conditions to 300 lei, but the risk increase and neuropsychic overload was increased to up to 25% of the monthly assignment allowance, and the one to maintain confidentiality to up to 5%.
