Sailors floating on ships under the so -called Cheap flags will be able to obtain the status of a sailor and register with ZUS to pay contributions on preferential principles – such a solution is introduced by the amendment to the Act on the social insurance system adopted on Wednesday.


254 deputies voted for the adoption of the law, no one was against, 178 abstained.
Now the Senate will deal with the law.
The amendment to the Act on the social insurance system and some other acts include seafarers with preferential principles regarding social security and determining the basis for calculating the premium. These solutions refer to the provisions used by the creators and artists. According to the estimates of the Ministry of Family, Labor and Social Policy, which has prepared the project, 17.7 thousand will be able to benefit from the new regulations. people.
As indicated in the justification, the purpose of the amendment is primarily to extend the rules for being subject to social insurance to persons performing work at sea on ships under the so -called cheap flags, i.e. countries not belonging to the European Union and the European Economic Area.
The Act introduces a provision according to which persons working on ships will obtain the status of a sailor performing work on the basis of a contract for the performance of work at sea. Thanks to this, they will be able to be covered by social and health insurance. The condition for taking up compulsory insurance – retirement and disability pension, sickness and accident will be submitting to the Social Insurance Institution for social insurance with a certificate issued by the director of the Maritime Office or the employment agency.
The obligation to pay contributions will last for 12 months, and this deadline will be calculated from the date of obtaining the status of a sailor indicated in the certificate. During this period, the sailor will be covered by full insurance protection, excluding the period in which after the end of work at the sea he will “suspend” the status of a sailor, for a period from a month to 3 months.
The sailor will submit to the Social Insurance Institution (ZUS, the insurance application for insurance within a month of issuing the certificate, i.e. until the expiry of its validity. An employee performing work on a sea ship under the Polish flag, will be able to change the title to social security from employee to the new title of sailor. To this end, he will have to provide the employer, i.e. the current payer of contributions, a statement on the selection of the title for insurance and a copy of the certificate issued by the director of the Maritime Office or the employment agency and to report to insurance as a sailor.
The basis for calculating the sailor's contributions will be determined in relation to the minimum wage, with the possibility of declaring a higher amount of contributions. In addition, it will be mandatory to pay contributions to the Labor Fund and the Solidarity Fund as well as health insurance contributions.
The project also provides for an additional possibility of retrospective, voluntary folding by sailors for a period of up to 5 years before the entry into force of the Act. According to MRPiPS, the solution can be particularly attractive to sailors who will soon reach a universal retirement age.
The Sejm adopted the Act along with a series of editorial and clarification corrections recommended by committees. (PAP)
