DNA chief, accused of a subordinate of blocked a hard file because his sister works at ASF / prosecutor woke up on the table with a job note

A prosecutor brings serious accusations to the management of the National Anticorruption Directorate (DNA), in an official document issued by the Judicial Inspection. The chief prosecutor of DNA, Marius Voineag, is accused of blocking a file in which the management of the Financial Supervisory Authority was targeted as his sister worked within the ASF, writes Recorder.
Earlier this year, prosecutor Neculai Cârlescu, at that time in office at the Section for Combating Offenses Assimilated to Corruption in DNA, received a service note that announced that he was moved to the Prosecutor's Judicial Section, which meant to stop any act in the files.
The prosecutor claims to have been affected independence
The notification, which carried the opinion of the head of DNA, Marius Voineag, came without having a prior discussion and without asking his agreement.
The magistrate had never worked on the judiciary – a prosecutors section that represents the prosecutor's office in the courtroom and supports the files before the court. Specialized in economic crimes, the Cârlescu prosecutor worked for two years at the Anti -Corruption Prosecutor's Office and had 23 files in instrumentation, which targeted offenses such as abuse in service and influence trafficking committed by officials and dignitaries with management positions in important institutions.
Cârlescu argues that his move was “a masked way to be removed from the criminal files”, a statement that can be found in a report by the Judicial Inspection at the request of the Section for Prosecutors of the Superior Council (CSM), called by the prosecutor Cârlescu to find that the measures ordered by the prosecutor, by the prosecutor, by the prosecutor, Ionuț Ardeleanu, affected his independence.
In December 2024, Cârlescu sent to the head of Ionuț Ardeleanu section that he would order the continuation of the criminal prosecution in a file that aimed in the way in which the management of the Financial Supervisory Authority controlled the activity of the Euroins insurance company.
Three weeks later, on January 23, 2025, Cârlescu received the service note by which he was assigned to the judicial section by the head of DNA Marius Voineag, a move that is equivalent to his removal from all the files he had in work.
Sister of DNA chief, employed at ASF
Neculai Cârlescu issued on January 30, the ordinance attributed to the former head of ASF, Nicu Marcu, the quality of suspect for abuse in service with very serious consequences.
“As president of the ASF, he exercised his duties in violation of the law because he intentionally delayed the withdrawal of the operating authorization, which led, to the prejudice of the creditors of the company with over 885 million lei,” wrote the prosecutor in the ordinance. Subsequently, the head of the section denied this measure, and on March 12, the file was classified by DNA.
“The magistrate revealed an alleged friendship relationship between the DNA chief prosecutor, Marius Voineag, and the persons investigated in the criminal files (… ASF president), but also personal interests (…), respectively the quality of employee within the ASF of the Sister of the Chief Prosecutor of the DNA. Judicial. Camelia Vlădescu, Voineag's sister, is the chief of the ASF in 2022, when the president of the institution was Nicu Marcu.
Cârlescu claimed that his direct boss, Ionuț Ardeleanu, also blocked other criminal prosecution documents, in files regarding CEC Bank or the City Hall, during the period when the mayor was Gabriela Firea.
After the completion of the checks and hearings, the report of the Judicial Inspection concluded that the independence of the prosecutor Cârlescu was not affected by the measures taken by his bosses, but this decision was denied by the head of the Directorate for Prosecutors, Liviu Mustață.
“It is found that the checks carried out are not complete, in the sense that the evidence proposed by the prosecutor Cârlescu Neculai was not administered and there was no ruling on them,” it is mentioned in the reasoning of the negative opinion.
