ROD plots for liquidation? The new bill assumes such a scenario

Protective zones created for defense purposes, which the government wants to establish a new bill, raise concerns of allotments. The Polish Association of Allotment Holders appealed to the correction of the regulations so that there is no expropriation – informs the website portalsmorzadowy.pl.


According to the bill, which the Council of Ministers adopted in April, the so -called Protective zones can be established by voivods. This possibility is provided for by the so -called defense law.
The government project provides for the possibility of expropriation in the case of plots intended for investments in defense. In this case, a simplified expropriation procedure would be used, which assumes the takeover of areas without full compensation taking into account only infrastructure depreciation. It is these provisions that raise special doubts and fears of Polish allotment holders.
Representatives of individual gardens appeal for a change in the provisions. In its position, the Polish Association of Allotment Party in its position indicates the need to ensure full compensation, including compensation for lost plantings, devices and facilities on the plots.
Equally important, in the event of any expropriation, PZD expects the possibility of reproducing a given allotment garden on another area indicated by a given commune and cover the costs of “removal”.
Not only protective zones
We would like to remind you that this is not the first problems of Polish gardeners in connection with the establishment of zones. Municipalities have only half a year to adopt new general plans that will indicate the purpose of each earth in their possession. They will replace the existing studies in the conditions and directions of spatial development.
Pursuant to the new regulations, municipal land will be divided into 13 planning zones, i.e. a multifunctional zone with multi -family housing, communication or service housing. Importantly for the future of allotment gardens, they will be able to be found in one in two: a single -family housing zone or a green zone and recreation.
According to the Polish Association of allotment, it can open the way to the liquidation of those allotment gardens that will be found in other zones. The problem can be especially burning in the largest cities.
The survival of allotment gardens now depends on the gardeners. The authorities of individual allotment gardens can still apply for the creation of an appropriate zone on the land on which there is a given family allotment garden. The application must contain detailed geodetic data. The model of the application was prepared by the Polish Association of Allotment Party. The organization also provides geodetic plans for individual RODs.
