Piedone has changed his mind / no longer wants shops to display commercial addition to each product

ANPC withdraws the order by which traders were obliged to display the commercial addition for each article, according to a document of the institution. The withdrawal decision comes after the consultations with the business environment, which resulted that the order would have discouraged the investments, generated confusion for consumers, led to facilitating some anti -competitive agreements and created differences between the Romanian online platforms from outside the country.

The institution details what would have been the effects of this order.

Investment discouragement: as investments will be affected in key sectors for the economy of Romania, such as food and non-food retail, distribution, processing, and, not least, production.

This aspect will have a negative effect not only on the economic operators in the food and non-food supply chain, but also in collateral industries, such as construction and building materials, enterprise and sub-enterprise, logistics and transport, etc.

Negative effects at the level of consumers: because by entering into force the order will not ensure better information of consumers or respect their rights.

Displaying on the shelf of purchase, import prices or price of the first distributor on the chain and the commercial addition, will obviously generate confusion at the consumers level, knowing these commercial details not bringing no real advantage, documented, for the latter.

Also, the quality of the products offered risks to decrease, the traders can be determined to choose for their portfolio with small addition, to the detriment of the high quality.

Negative effects at the level of B2B relations – which cause an imbalance at the level of the B2B supply chain and the commercial relations exclusively between professionals (importer – distributor – distributor, distributor – trader – producer, producer – processor), in considering the risks associated with the disclosure of commercial secrets Concerted, as well as the initiation of waves of conflicts in this context, in the context of the purchase price negotiated according to volumes, distance, etc., aspects that are unknown to consumers, or as the significant expenses that appear in the production chain, processing and commercialization or multiple taxes that the state operators or the local operators are not.

The difference in treatment between traders and online platforms established on the territory of Romania in comparison with those outside Romania, especially from third states – an additional information obligation for traders and online platforms will be created, without complying with the obligation being controlled and sanctioned in relation to the traders and the online platforms in Romania.

In view of the systematic violations of the EU law committed by the platforms that come from third states and the lack of concrete actions of supervision and sanction from the national authorities, thus the treatment differences between the two types of economic operators will be emphasized.

In view of the mentioned aspects as well as the possibility of decreasing the competitiveness of Romania in relation to other EU member states, the order regarding the information of consumers by the economic operators regarding the commercial addition applied to the products marketed in relation to the purchase price, withdraws.

ANPC wanted stores to display the commercial addition to each product

The General Control and Surveillance Directorate of the ANPC has published in mid -March a draft on the information of consumers regarding the commercial addition applied to the products marketed in relation to the basic price of the manufacturer.

According to the project, companies will be obliged to inform consumers, by registering on the product or in the immediate vicinity where it is exposed to the commercial addition applied to the product in relation to the basic price of the manufacturer, in the same field of visual where the price is displayed and using the same characters, color and size.

“In the case of online trade, the display will be displayed” in the same visual field in which the price of the product is exposed, using the same font, color, size and other characteristics as those used to highlight the price of the product “, shows the quoted document.
