The government extends asylum restrictions. What does the new regulation mean?


The ordinance exercises the entitlement granted to the government by the Sejm on September 12, which agreed to further temporary suspension of the right to asylum. It is to come into force on the day of its announcement.
The regulation is issued on the basis of the so -called asylum law to counteract the so -called Belarus's migration instrumentalization in cooperation with Russia and criminal groups. The government indicates that such activities create artificial migration pressure and pose a serious threat to the security of the state and society.
The restriction was introduced for the first time on March 27, 2025, and then extended twice: May 23 and July 24. Currently valid until September 22.
Exceptions to restriction
Temporary limitation does not include:
- minors unattended,
- pregnant women,
- people who require special treatment due to age or health,
- people clearly threatened with a serious risk of harm in a state of origin,
- citizens of countries using migration instrumentalization.
Conclusions from these people will not be accepted if a foreigner committed to preserve the use of direct coercion measures or weapons after crossing the border using violence in cooperation with others.
Criticism of social organizations
Organizations that help refugees oppose restrictions. In their opinion, the regulations violate, among others art. 56 para. 2 of the Polish Constitution, guaranteeing foreigners the possibility of applying for refugee status, as well as obligations arising from international conventions, including the convention regarding the status of refugees from 1951.
From the entry into force on March 27 to August 28, applications have not been accepted from 221 foreigners.
