The draft amendment to the Act on Land and Mortgage Registers and the Act on the National Court Register, for which the deputy head of the Ministry of Justice Arkadiusz Myrcha is responsible, was entered in the list of government works this Friday. Designed provisions that They are part of the deregulation solutions, they are to enter into force on March 31, 2026. The term results, among others from the assumptions of the “Development and increasing the availability of court registers – EKS and ECW” part of the national reconstruction plan and increasing immunity.
The planned date for the project adopting by the government is the third quarter of this year.
Land and Mortgage Register on a mobile phone
The designed changes provide for the possibility of self -downloading electronic documents from the central information of the land and mortgage register through enabling the collection of land and mortgage registers from the ICTlifts from land and mortgage registers and certificate of land and mortgage register closing in the form of electronic documents and to give these documents the power of documents issued by the court.
Subsequent changes relate to the wider use of the MOBIATR app. It's about the possibility free search in this application of land and mortgage registers by PESEL number and data from the National Court Register (KRS) regarding the entity entered in the register, which is to facilitate and improve the view of these databases.
The project is to enable the acquisition of data from the National Court Register regarding the entity entered in the register of entrepreneurs or the register of associations, other social and professional organizations, foundations and independent public healthcare facilities – including in the scope of registering in the ICT system of the case or making an entry in the position of the register, If they apply to data from the entities with which the application user is related to PESEL.
“Documents made available by the central information of the land and mortgage registers for independent printing via the ICT system before the date of entry into force of the Act, they will retain the power of documents issued by the court, if they have features enabling their verification with the data contained in the central database of land and mortgage registers” – indicated in the list of legislative work.
It has been added that the extension of the functionality of the MOBIATR application will cause the need to introduce a change in the Regulation of the Council of Ministers of July 2023 on the scope of data and a list of public registers as well as ICT systems of public entities, from which the Mobat Citizen User may download data.
