7 committees exchanged Nawrocki's voices with Trzaskowski. The prosecutor's office may request a recalculation

The prosecutor became familiar with the Supreme Court reports to recalculate voting cards from 10 peripheral election committees; In 7 of them there were votes, which resulted in the erroneous acceptance that Karol Nawrocki obtained a larger number of votes in these circuits – the spokeswoman of PG was announced.

Anna Adamiak reported on Saturday that – to ensure the participation of PG in the proceedings regarding the SN recognition of electoral protests – Adam Bodnar authorized the prosecutor from the Department of Court Provision of the National Prosecutor's Office to read in the Supreme Court with the reports of voting cards.
As reported, the authorized prosecutor on Friday became familiar with the files in which there were protocols for recalculating the voting cards in 10 regional election committees (Kraków, Tarnów, Katowice, Strzelce Opolskie, Mińsk Mazowiecki, Olesno, Grudziądz, Kamienna Góra, Wieniec-Zacić Kujawski, Gdańsk).
According to the PG spokeswoman, the analysis of the inspection shows that in seven committees there were votes cast for individual candidates for the office of president, “which resulted in the erroneous assumption that Karol Nawrocki obtained a larger number of votes in these circuits, while Rafał Trzaskowski received this number of votes. It was specified that these are the regional election committees in: Krakow, Strzelce Opolskie, Mińsk Mazowiecki, Olesno, Grudziądz, Wieńcie-King-Kujawski and Gdańsk.
The prosecutor's office reported on platform X that there was a total of irregularities in nine out of ten committees.
Prok. Adamiak said that in the District Electoral Commission in Katowice there was a mistaken added to both candidates invalid votes, while in the commission in Kamienna Góra it turned out that the package containing votes cast for the candidate Karol Nawrocki had important voices cast for Rafał Trzaskowski. As reported in the communiqué, “from the recalculation of votes shows that in the circuit Rafał Trzaskowski obtained the greater number of votes, not Karol Nawrocki, as indicated in the commission report.”
The PG spokeswoman said that “the deficiencies revealed in the work of the District Electoral Commission in Kamienna Góra justify the checking proceedings by the local and material organizational unit of the prosecutor's office in connection with the possibility of committing a crime.”
As for the electoral commission in Tarnów, the inspection – as reported – confirmed the result of the vote recorded in the protocol.
The announcement announced that “in view of the next irregularities in the election process, the Prosecutor General will strive to clarify all doubts raised in protests, claiming, if necessary, for recalculating electoral cards.” PG spokeswoman indicated that in justified cases preparatory proceedings would be initiated in order to determine all circumstances and make their legal assessment.
For several days, the media have been informing about irregularities related to counting votes in some committees during the second round of presidential elections. Last week, in connection with the election protests brought in, the Supreme Court decided to inspect cards from a total of 13 regional election committees, including in committees from Krakow and Mińsk Mazowiecki. Visual inspection was also ordered, among others in relation to two regional electoral commissions from Bielsko-Biała.
The Supreme Court recognizes protests composed of three judges in non -litigious proceedings. “If the need to conduct evidence appears in the course of recognizing the protest, a decision is issued to allow and take evidence, e.g. from the testimonies of witnesses or inspecting the voting cards,” said the Supreme Court. After recognizing the protest, the SN may leave it without further running. This means that the protest for formal reasons cannot be recognized in substance.
If the protest is recognized in substance, the Supreme Court may express the opinion that the protest is unfounded or that it is reasonable. “In the event of an opinion on the legitimacy of the allegations of protest, the Supreme Court indicates whether the irregularities found had an impact on the result of the election” – said the Supreme Court.
After recognizing all election protests, based on the report on the election presented by the PKW, the Supreme Court decides on the validity of the election of the President of the Republic of Poland – it must do so within 30 days of making the results of the choice to the public. This means that the last day that must be made this decision is July 2 this year.
On Friday, SN spokesman Aleksander Stępkowski told PAP that the number of all election protests could reach 50,000.
Pursuant to the provisions introduced in 2018 during the PiS rule, competent for considering election protests and finding the validity of the election, the Extraordinary Control and Public Affairs Chamber of Supreme Court is created at that time. It is made up of persons appointed after 2017 to the office of a judge at the request of the National Council of the Judiciary shaped in the manner specified in the provisions of the CRS Act of 2017. For this reason, the status of this chamber is questioned by the current government, which recalls here, among others Jurisprudence of the Court of Justice of the EU and the European Court of Human Rights. Before 2018, the election issues were considered by the then Insurance and Public Affairs Chamber.
Adam Bodnar consistently indicates that there is a need to exclude all judges of the Chamber of Extraordinary Control and Public Affairs of the Supreme Court from adjudicating in matters of electoral protests, because as a result of the procedures they were appointed by the National Court Register after 2017 and “do not meet the requirements of independence and impartiality, and thus cannot be considered as established in accordance with the Polish Constitution.”
Stępkowski emphasizes that “the only chamber attached legally to recognize protests is the Chamber of Extraordinary Control and Public Affairs of the Supreme Court.”
