Legal dispute around the Dukovana Power Plant


Last week, the Czech Prime Minister Petr Fiala canceled the participation in the signing ceremony of the contract with KHNP for the construction of new energy blocks at the Dukovana nuclear power plant. Its conclusion was blocked by a Czech court, to which French EDF appealed. According to the decision, the contract cannot be signed until the appeal procedure is resolved.

Regnier said that the EC in a letter to the Czech Republic raised its reservations under the regulation on foreign subsidies. It concerns controlling the help provided by the rule of third countries to enterprises operating on the EU common market. The letter was sent to Prague by the Vice -President of the EC, Frenchman Stephane Sejourne.
Regnier emphasized that The EC already informed the Czech Republic about its reservations in February, but did not receive an answer. However, he pointed out that the EC did not contribute to the delay of anything that is related to the implementation of the Dukovana Power Plant expansion project – Czech court did it earlier.
“It is not that the French Commissioner defends French interests, on the contrary – he is a member of the EC who is involved in the enforcement of EU law” – emphasized Regnier, referring to the fact that a French commissioner is signed under the EC letter.
After answering the EC letter, he may initiate an investigation into possible foreign subsidies.

The extensive Dukovany gym is to generate 1200 MW of electricity. The Czechs announced a construction support plan in March 2022. First, they reported this plan to the EC, which accepted it; Only then they emerged KHNP as a partner.
Poland is waiting for its acceptance of its support for the construction of the first nuclear power plant; The technology supplier will be the American Westinghouse. In turn, KHNP is to be a supplier for the second power plant construction project in the initial phase.
