President Karol Nawrocki announced on Thursday that he had signed the amendment to the Act on the National Labor Inspectorate (PIP), but sent it for subsequent evaluation by the Constitutional Tribunal. The reform gives PIP the power to turn bogus civil law and B2B contracts into employment contracts.

– The state must be strong, but it cannot be excessive in its interference. The Constitution clearly mentions the principles of subsidiarity and proportionality. Public authorities cannot exceed the limits of their influence on economic life and this must be clearly assessed, he said.

The regulations assume that the labor inspector – if any irregularities are detected – will have the opportunity to first issue an order regarding the functioning of the civil law contract or failure to conclude an employment contract – in a situation where the features of an employment relationship dominate in the legal relationship between the parties.

If the order is not complied with, the inspector will have the opportunity to apply to the district labor inspector to initiate administrative proceedings, which may end with the issuance of a decision to transform the contract or a lawsuit to the court to establish the existence of an employment relationship.

The decision may be appealed to the court. It will be suspended until a final decision is made. (PAP)
