Ludovic Orban says that the position of the magistrates is “completely unreasonable” and “cannot be accepted”. The president's adviser also circulates the scenario of a revision of the Constitution

Ludovic Orban, the advisor to President Nicușor Dan, said on Antena 3 on Saturday that he has “no hope” that the project regarding the special pensions of magistrates will not be challenged by the High Court at the Constitutional Court, but that the Government must adopt it anyway, as quickly as possible, in the hope that it will end up being promulgated and meet the November 28 deadline for fulfilling the PNRR milestone.

The former prime minister believes that the position of the magistrates is “completely unreasonable”.

“The government must adopt the draft law in its final form. At the mediation made by the president in Cotroceni, on Tuesday, they came to an understanding (…). There was an attempt to dialogue with the magistrates, with the High Court of Cassation and Justice, in the hope that they will not attack the Constitutional Court (…). The position expressed by the representatives of the magistrates is a completely unreasonable position, it cannot be accepted”, declared Ludovic Orban.

He urged the magistrates to “take public opinion into account”.

“Magistrates are the ones who must do justice. Magistrates are the ones who must take into account the letter and spirit of the Constitution and the laws. Magistrates must understand that they are part of a judicial power, one of the three powers of the state, in which they must, however, take into account public opinion, society,” continued Orban.

The presidential adviser said that the Government must “choose the fastest way of adoption, probably hiring liability”, being “the only chance that if the High Court of Cassation and Justice does not attack the Constitutional Court, the November 28 deadline can be met”.

What he said about the scenario of a revision of the Constitution

Asked if he has any hope that the project will not be attacked at the CCR, Ludovic Orban said: “I, personally, do not. I know the characters there and I have no hope, I tell you honestly. They will attack at the Constitutional Court, but let them attack at their own risk.”

“I'm sitting and thinking, if even these conditions don't accept them, why don't we try again, maybe even through a revision of the Constitution, to impose a single pension calculation system, namely proportional to the contributions paid by each employee, regardless of the field of activity? That is to say that all employees should be equal before the law”, Ludovic Orban also declared.
