Former president of the Supreme Audit Office, Mariusz B., suspected of violating fiscal secrecy


The Regional Prosecutor's Office in Białystok informed about the charges against the former president of the Supreme Audit Office.
“In the course of the investigation RP I Ds.22.2019 supervised by the Regional Prosecutor's Office in Białystok, in the thread regarding inciting the disclosure of information covered by fiscal secrecy by officers of the National Tax Administration to an unauthorized person, on November 12, 2025, procedural activities were carried out consisting of announcing a decision to present charges against the former President of the Supreme Audit Office, Marian B., and interrogating him as a suspect” – said the spokesman of the prosecutor's office, Zbigniew Szpiczko, in a statement.

What are the accusations against the former president of the Supreme Audit Office?
As stated in the press release, during the investigation the accused was charged with:
- two acts under Art. 18 § 2 of the Penal Code in connection with Art. 306 § 1 of the Act of August 29, 1997 – Tax Ordinance,
- one qualified act under Art. 18 § 2 of the Penal Code in connection with Art. 306 § 1 of the Tax Ordinance and Art. 231 § 2 of the Penal Code in connection with Art. 11 § 2 of the Penal Code
Pursuant to Art. 306 § 1 of the Tax Ordinance: “Whoever, being obliged to maintain fiscal secrecy, discloses information covered by this secrecy, shall be subject to the penalty of imprisonment for up to 5 years.”
However, art. 231 § 2 of the Penal Code provides: “If the perpetrator commits the act specified in § 1 in order to obtain material or personal benefits, he or she shall be subject to the penalty of imprisonment from one to 10 years.”
Thus, the accused faces serious charges, including both violation of fiscal secrecy and abuse of powers of a public official in order to obtain benefits.

Position of the former president of the Supreme Audit Office
The person concerned himself referred to the case on the X website. “I have read their content and have not admitted any of them. This is the result of a political campaign started by the previous government,” he wrote.
