People with income from copyrights are exempted from e-Invoice, according to an amendment of the Finances

The amendment was supported by the Ministry of Finance for the simplification of RO e-Invoice adopted in the Budget-Finance Committee of the Chamber of Deputies, according to a statement sent by Finance on Monday.
We remind you that a petition launched on the Declic platform, through which the signatories ask the Ministry of Finance and ANAF to cancel the obligation to enroll in the RO e-Invoice system for natural persons who obtain income from copyrights and are not organized as PFA or companies, gathered thousands of signatures in just one day, according to StartupCafe.ro

Interim Prime Minister Ilie Bolojan said last week, on the HotSpot podcast from HotNews, that he has already received notifications regarding the extension of the e-Invoice system to individuals, which he says generates “an additional bureaucracy”, which is why he is going to discuss this issue with the Ministry of Finance.
Bolojan spoke about the results of the 10-month mandate, including fiscal measures with an impact on Romanian entrepreneurs.
“We continued digitization and right now, for example, the expansion of the e-invoice system would come into force, for all people, including individuals, who have various small businesses. Now, this means, for example, additional bureaucracy, I have already received reports on this topic and today I proposed to discuss with the Ministry of Finance to see if this measure is really necessary, if it really combats evasion or if it is just a form of bureaucracy in plus”, announced Ilie Bolojan.
The Ministry of Finance supported an amendment adopted on Monday in the Budget-Finance Committee of the Chamber of Deputies, which simplifies the rules for using the RO e-Invoice system and reduces bureaucracy for individuals and certain categories of taxpayers.
The amendment, which modifies Emergency Ordinance no. 120/2021 regarding the RO e-Invoice national system, was taken up and supported by all members of the Commission.
“Through these changes, the aim is to maintain the objectives of digitization and fiscal transparency, while avoiding the introduction of disproportionate administrative burdens for natural persons or small-scale economic activities”, claim the authors of the release.
According to the amendment, natural persons who obtain income from copyrights, agricultural activities, as well as foreign cultural institutes and centers operating in Romania based on intergovernmental agreements are exempted from the obligation to use e-Invoice.
The main proposed changes aim at:
- eliminating the obligation to use the RO e-Invoice system for natural persons who are fiscally identified by personal numerical code (CNP), they will only be able to use the system optionally;
- exemption from the obligation to use the RO e-Invoice system for natural person farmers who apply the special regime for farmers, considering that they already use marketing books that ensure the traceability of operations and contain the mandatory information from the invoice;
- exempting the institutes and cultural centers of other states that operate in Romania based on intergovernmental agreements, in the context of the technical and administrative difficulties generated by the lack of a fiscal identification code;
- introducing the possibility of deletion from the RO e-Invoice registers for people who no longer have the obligation or no longer wish to use the system.
Also, as an element of novelty, natural persons who are fiscally identified through CNP will no longer have the obligation to use the RO e-Invoice system, the use of which will remain optional, and persons who no longer have the obligation to use the system or no longer wish to use it will be able to request deletion from the RO e-Invoice registers.
“We have corrected a real problem, reported by many professional categories and civil society. The state must be firm where there is evasion, but reasonable and predictable with people who correctly declare their incomes. The digitalization of ANAF and the modernization of the tax administration remain clear priorities, but these reforms must mean simplification and less bureaucracy, not disproportionate obligations for people who do not carry out economic activity in a commercial sense,” said the Minister of Finance, Alexandru Nazare.
The proposed measures allow, at the same time, to preserve the optional nature of the system for people who want to use the RO e-Invoice and maintain the objectives of digitization, traceability and combating tax evasion assumed by the reforms carried out by Romania.
The Ministry of Finance emphasizes that the process of fiscal digitization and the expansion of the use of electronic tools will continue, including through the development of ANAF's digital systems and the simplification of services for taxpayers. At the same time, the fiscal framework must be adapted to economic and social realities, so that administrative measures are proportionate and predictable.
The Ministry of Finance reaffirms its commitment to building a modern tax administration, oriented towards efficient digital services, combating tax evasion and strengthening a fair and functional relationship with honest taxpayers.
