The government wants to force RA-APPS to say who lives in the protocol villas and how much they pay: “The state is no one's estate”
The government wants to force RA-APPS to publish the complete list of its buildings, those who use them and how much they pay for it, states a USR press release.
Thus, the Government made transparent on Thursday, at the proposal of the General Secretariat of the Government, a draft Government Decision obliging the Autonomous Region “State Protocol Heritage Administration” (RA-APPS) to make public the complete list of buildings under its administration, as well as the way in which they are used.
A Government meeting is scheduled for Thursday at 14:00. The executive led by Prime Minister Ilie Bolojan was dismissed by Parliament on May 5 and has limited powers, but can issue Government Decisions.
According to the project, RA-APPS will publish on its own website, on May 31 and November 30 of each year, the list of all buildings, public and private property of the state
“For years, the RA-APPS heritage was treated as a state secret for the privileged. Villas, apartments, protocol spaces and lands owned by the state were offered through all kinds of contracts and arrangements about which the Romanians knew little or nothing,” said Dan Reșitnec, the Secretary General of the Government, appointed by the USR.
The initiative comes after, the press release recalls, USR deputy Ionuț Moșteanu officially asked RA-APPS to publish the list of those who live in villas managed by the Directorate, and the Minister of the Environment, Diana Buzoianu, opened court action against RA-APPS for publishing the same list.
She won the case at first instance, but RA-APPS appealed.
“What could not be achieved through individual actions for years, from the opposition, can be achieved today through the Government's decision”, stated Reșitnec.
“If the use of public property is correct and legal, then there should be no problem with this information being public. The state is not anyone's property,” he added.
What RA-APPS will have to publish, according to the project;
- a) the address of the building, the developed area, the area of the land;
- b) purpose of the building: living space, office space, space with another purpose;
- c) in the case of the legal entity that uses the building, specify: the name of the central or local public authority or institution, trade union organization, political party, foundation, association, law firm, notary office, unit belonging to religious cults, press or publishing unit, diplomatic mission, consular office, representative of the international intergovernmental organization accredited in Romania, other institutions;
- d) in the case of the natural person who uses the building, specify: (i) the category of the beneficiary's position: dignitary, high civil servant, civil servant, staff with special status, contractual staff, other category, without mentioning the explicit title of the position; (ii) the category of the institution in which it operates: parliamentary office, ministry, agency, authority, office, council, institute, state secretariat, directorate, department, other category, without mentioning the explicit name of the institution;
- e) the type of contract concluded: rental, free use, provision of services, association;
- f) the legal basis on the basis of which the building was assigned to the beneficiary and the form of contract allocation: by direct assignment with the approval of the authorized institution or by auction procedure, according to the law;
- g) date of commencement and date of termination of the contract;
- h) the contract price or the monthly rent, if applicable
