A request to waive the immunity of PiS MEP Mariusz Kamiński has been submitted to the European Parliament, said the head of the European Parliament, Roberta Metsola, on Monday. This concerns Kamiński's actions as the head of the CBA related to the “assumed thesis” that Jolanta and Aleksander Kwaśniewski bought the house on behalf of a fake person.

– The competent Polish authorities asked me to waive the immunity of Mariusz Kamiński – said Metsola, opening the four-day EP meeting in Strasbourg on Monday.

She added that she submitted the application to the JURI legal affairs committee.

On March 31, Prosecutor General Waldemar Żurek asked the European Parliament to waive Kamiński's immunity. It was about Kamiński's actions from 2007-2009 as the head of the Central Anticorruption Bureau, related to the “assumed thesis” that Jolanta and Aleksander Kwaśniewski bought a house in Kazimierz Dolny on behalf of a third party.

Any request to waive the immunity of an MEP is sent to JURI, which prepares a report on the matter. The Commission is not obliged to prepare this document within a specific deadline, it usually takes several months. The motion is then put to a vote in a meeting of the entire chamber. The European Parliament decides to waive immunity by a simple majority. The waiver of immunity does not mean that the MEP is found guilty, but only allows national judicial authorities to conduct an investigation or trial. MEPs are elected in accordance with national electoral laws, so if they are found guilty of a crime, it is up to the Member State authorities to decide whether to revoke their mandate.

The European Parliament will vote on Tuesday on lifting the immunity of PiS MEPs Daniel Obajtek, Patryk Jaki, Grzegorz Braun and Tomasz Buczek, European Parliament President Roberta Metsola announced on Monday, opening the four-day meeting in Strasbourg.

In the case of MEP Jaki, it concerns criminal proceedings and a private indictment filed by Judge Igor Tuleya. In the case of Obajtek – about his actions as the president of Orlen regarding blocking the distribution of the weekly “NIE” at the company's stations because of the cover with Pope John Paul II.

The immunity of Braun, representing the Confederation of the Crown of Poland in the European Parliament, is to be waived for the fourth time. This time it is about blocking the access road in Jedwabne on July 10, 2025, during the celebration of the 84th anniversary of the massacre of the Jewish population.

The case of Buczek, an MEP from Confederation, concerns the violation of the bodily integrity of a participant in one of the demonstrations.

Immunity is lifted each time in relation to a specific case. (PAP)
