They will again try to sue the Krasnoyarsk developer for half a billion for the lands of the combine plant

They will again try to recover 579 million rubles from the Novoostrovsky group of companies (affiliated with the Krasnoyarsk construction company Sibiryak, owned by businessman Vladimir Egorov) for illegally occupied land of the former Krasnoyarsk combine harvester plant.

The prosecutor's office recalled that federal land with an area of 658 thousand square meters was transferred to private hands in 2013. The Novoostrovsky residential complex began to be built on this site. It soon became clear that the project did not include either kindergartens or schools. According to the standards, the district was designed for 30 thousand residents, which means it required at least five kindergartens with 300 places each and three schools with 1.1 thousand places.
The prosecutor's office conducted an inspection and found that the plots were removed from state ownership without legal grounds, and the development project was constantly changed in the direction of reducing social facilities.
The department filed a claim with the regional Arbitration Court to recover the market value of the land – 579 million rubles. The court of first instance supported the prosecutor's office. However, the higher court overturned this decision, citing the expiration of the statute of limitations.
The day before, the prosecutor's office appealed the decision in cassation. The agency insists that the statute of limitations should be counted not from the moment of privatization, but from the day when it became known about the violation of the rights of future residents left without social infrastructure. In addition, the defendant concealed the actual plans for the development.
The Court of Cassation agreed with the arguments of the prosecutor's office and sent the case for a new trial on appeal. Now the prosecutor's office has a second chance to achieve recovery.
The construction of residential buildings did not stop. The prosecutor's office initially did not demand the demolition or freezing of the objects – due to the existing share participation agreements. The rights of shareholders are protected by the mechanism of escrow accounts, their money is safe.
