In the Krasnoyarsk Territory, a carrier was fined after an accident with a minibus

The carrier was fined for violations after an accident with a minibus on the Uzhur-Krasnoyarsk highway. The regional prosecutor's office spoke about this.

The accident occurred in January of this year; the minibus set out on the route in bad weather conditions. With limited visibility, the driver lost control and collided with a Scania truck. An 11-year-old boy, one of 14 passengers on public transport, was injured in the accident. The child received a splintered fracture of his leg, a concussion, as well as multiple bruises to his face and head. He was urgently hospitalized at the regional center for motherhood and childhood in Achinsk, operated on and prescribed treatment.

After the incident, the prosecutor's office checked the entrepreneur who organizes intercity passenger transportation and discovered serious violations. It turned out that the drivers’ work and rest schedule was systematically violated—overtime shifts exceeded 40 hours per week, and pre-trip briefings and inspections of equipment were not documented.

“Instead of a legal group agreement for the transportation of passengers, the entrepreneur, upon request, entered into a separate bus rental agreement with each person, issuing individual tickets with full name and route. This disguised regular flights as private charter, depriving passengers of consumer rights – insurance, guarantees of return, priority during evacuation – and diverting them from safety control,” the press service of the supervisory agency reported.

The prosecutor made a representation to the entrepreneur and opened 4 administrative cases for violations of the work and rest regime of drivers (Part 3 of Article 11.23 of the Code of Administrative Offenses of the Russian Federation), disguising flights as individual charters (Part 5 of Article 11.14.2 of the Code of Administrative Offenses of the Russian Federation), lack of pre-trip control of equipment (Part 3 of Article 12.31.1 of the Code of Administrative Offenses of the Russian Federation) and skipping driver briefings (Part 5 Art. 12.31.1 Code of Administrative Offenses of the Russian Federation). The total amount of fines exceeded 250 thousand rubles.

In the interests of the hospitalized child, the prosecutor's office filed a claim for compensation for moral damages for physical and moral suffering. The amount of payments, taking into account the severity of the consequences and the principles of fairness, will be determined by the court.
