The case concerned an update introduced in the summer of 2019 to the first generation of the 2013-2015 Tesla Model S. After installing it, some users noticed a noticeable slowdown when using fast chargers. The courts determined that the charging rate could have decreased by up to approximately 30%.
The manufacturer explained the restrictions introduced by the concern to extend battery life and safety issues, pointing to the risk of battery fire.
Vehicle owners, however, argued that the company unilaterally worsened a key feature of the car after its purchase and did not warn customers about the consequences of the update.

Tuesday's ruling by the Supreme Court ended a dispute that had lasted several years. Previously, four drivers won a precedent-setting trial before lower instances. Currently, another 115 people have obtained the same decision and each of them will receive compensation in the amount of PLN 50,000. Norwegian kroner, i.e. approx. 18 thousand zloty.
