ZUS will calculate pensions for women over 65 years of age. Who will benefit and how much can you gain?

ZUS calculates the pensions of women who retired at the age of 60 and had funds in OFE. After turning 65, their benefits are recalculated and for many employees this may mean an increase in benefits by up to half.
Recalculating the pension benefit is not a sudden change or amendment to the regulations implemented by ZUS. However, it takes some time for some women to notice a significant increase in their benefits each month.

Not every pensioner has the right to have her pension recalculated. This is determined by the year of birth and participation in OFE. As “Gazeta Prawna” explains, in the case of women who retired at the age of 60, their benefits are calculated again after they turn 65.

This takes place without reducing any previously paid funds. The average pension increase may reach even more than 50%.
The case concerns women born between 1949 and 1968 who were members of OFE. As “Gazeta Prawna” explains, women who have not joined OFE immediately receive a lifetime benefit and have no right to recalculation.

The situation is different in the case of women who took advantage of the opportunity to retire after reaching the age of 60 and who joined OFE earlier.
As “Gazeta Prawna” explains, the assumptions of the pension system mean that in 2026 the recalculation will include, among others: women born in 1961 who will turn 65 this year. Women from outside this group – especially those who have not joined OFE – have no right to recalculation on such principles.

According to “Gazeta Prawna”, after recalculation, the pension may increase, for example, from PLN 2,200 to PLN 3,200 (an increase of 45%) or from PLN 2,500 to PLN 3,800 (an increase of 52%). As “Gazeta Prawna” points out, the values are indicative because the actual amount depends on the accumulated capital and the moment of retirement. Life expectancy should also be taken into account, which is included in the Central Statistical Office tables.
Higher pension for some women. Cases go to court
As “Gazeta Prawna” notes, the growing awareness of the regulations causes some women – whose pensions have not been recalculated – to decide to take legal action. Their arguments are similar and most often concern unequal treatment of the insured, lack of justification for the division of persons belonging to OFE and those not belonging to OFE, as well as violation of equality before the law.

Expert opinions quoted by “Gazeta Prawna” indicate that the problem is not particular, but systemic. The administration, however, does not announce changes to the system that would equalize opportunities and correct the error in the pension system.
