PLN 1.5 billion at stake. PKP Cargo and the State Treasury are suspending the court battle

PKP Cargo received a decision of the District Court in Warsaw to suspend the proceedings in the case of the so-called coal decision – the company said in a press release.

“The above decision of the Court was issued as a result of the company and the General Prosecutor's Office of the Republic of Poland submitting applications to suspend the proceedings regarding the so-called coal decision, about which the company informed on March 4, 2026,” the company wrote in the press release.

On December 23, 2025, the company announced that filed a lawsuit against the State Treasury regarding a claim for compensation for the so-called coal decision. The company is represented in the proceedings by the administrator of the restructuring estate, PKP Cargo w restructuring. The value of the subject matter of the dispute is PLN 1,522,424,000.

As the company announced at the time, PKP Cargo is seeking compensation from the State Treasury – the Prime Minister and the Minister of State Assets – for damage resulting from the implementation of tasks imposed on the company by the decision of the Prime Minister of July 25, 2022, as amended by the decision of the Prime Minister of October 6, 2022, and the State Treasury's failure to fulfill the obligation to conclude an agreement with the company regulating the principles of financing the implementation of the task covered by the above-mentioned. decision and resulting from the provisions of the Act of April 26, 2007 on crisis management.
