Will Poland leave the ECJ? Jacek Sasin's clear declaration
“We are leaving the ETS. This is not a slogan, we take the declaration of our candidate for Prime Minister Przemysław Czarnek seriously, it is a real plan that we have” – said Jacek Sasin, an MP from Law and Justice and former Minister of State Assets, during Saturday's conference. “We have a judgment of the Court of Justice from June last year, according to which the procedure for adopting the ECJ was inconsistent with the constitution, with European regulations, and with European treaties,” he added.
He noted that the judgment had not been published, but – according to him – it was the law in force in Poland.

“The act introducing the ETS in Poland dates back to 2015. We intend to submit a draft act to withdraw this act from legal circulation, which will mean that there will be no grounds for maintaining the ETS in Poland,” said Jacek Sasin.
He emphasized that The ETS “overwhelms the energy sector, industry, especially energy-intensive ones.” He added that ETS2 will destroy Poles. He also emphasized that as Poland “we must have a balanced energy mix” and that none of its pillars should be abandoned.
ETS is a system for trading CO2 emission rights, which currently covers the energy sector. ETS 2 is to come into force from 2028, a system that will cover emission rights, among others. transport or construction.
Jacek Sasin on the future of the Polish energy industry: first, coal
“Firstly, coal, secondly, nuclear energy and, as the third and supplementary pillar, renewable energy sources. There is no space for Poland as a country to invest in renewable energy. We already have them very strong, in recent years there has been a lot of support for renewable energy, but this does not mean that they produce the expected results,” he said.
He noted that renewable energy sources are used for a large part of the year by 1/3, and in some periods their capacity is only used by a few percent. He added that currently “we have 10 GW in wind farms, 25 GW in photovoltaics, investments have started for 6 GW in the offshore sector.”

He expressed his belief that further expansion of this sector would mean gigantic investments in infrastructure that Poland cannot afford. And this money must be allocated to other energy sectors, including nuclear energy.
“Today, the most important task is to invest in the maintenance of coal infrastructure. There was no investment in this sector because, among other things, there was no possibility of financing them“- he also said.
He emphasized that investments in renewable energy should be made on market principles. He added that if someone wants, they will be able to invest in these energy sources.
“The USA has stopped state subsidies for renewable energy, this is a very good path, the path we intend to follow,” said Jacek Sasin.
PiS already has a candidate for prime minister
A week ago, the announcement of the termination of the ECJ was made by PiS MP Przemysław Czarnek, whom the party presented as its candidate for prime minister after the next elections. During the PiS convention in Krakow, he said that representatives of a “strong state” should go to Brussels and declare, among other things, the EU ETS system, renewable energy sources or the Green Deal.
Minister of Climate and Environment Paulina Hennig-Kloska, referring to these words, emphasized that “Poland's exit from the ETS system means Poland's exit from the European Union.”
