GetBack scandal. NIK submitted another notification of suspicion of crimes

The Supreme Audit Office, investigating the GetBack case, sent another notification to the prosecutor's office about the suspicion of committing crimes – NIK informed on Wednesday, the notification concerns hindering the inspection.

It has been added that the notifications relate to the act of art. 98 of the Act on the Supreme Audit Office, i.e. criminal liability for obstructing the inspection and were directed to two persons – deputy prosecutor general and an expert involved in preparing opinions in connection with the transaction of assignment of debt portfolios.
This is another notification recently that the Chamber submitted to the prosecutor's office in connection with the hindering of control.
NIK control began in February 2024, and its purpose is to verify the KNF supervision over GetBack SA activities, currently Capitea SA and entities cooperating with the company. The results of the inspection – as announced in February this year. – They are to be published at the turn of March and April this year.
NIK representative Janusz Pawelczyk informed in February 2025 that the controllers came across “great resistance” in clarifying the matter on the part of state institutions. He specified that these resistance was manifested, for example, in delays in the transmission of materials. He said that controller teams questioned several dozen people, including from the KNF office, which shared “huge and very useful” knowledge, and the Supreme Audit Office collected “a huge amount of materials”.
The very investigation into the so -called GetBack scandals were initiated in April 2018, the day after the KNF notification was submitted. A special investigation team was established. On May 11, 2018, the first searches and security of documents, information carriers and property were made, and in June 2018 the former president of Getback was detained. In connection with the investigation, PLN 400 million was secured, including valuables, jewelry, real estate, securities and money on bank accounts.
In February 2022, a trial in this case started before the District Court in Warsaw. The victims are over 9,000 Company bondholders who lost almost PLN 3 billion. The allegations relate to fraud related to the distribution of GetBack bonds and investment fund certificates, abuse of powers and the idea of the Bank of financial damage in great size and the Bank's brokerage activities without the required KNF authorization. The prosecutors in the case are GetBack, KNF, as well as the company itself.
GetBack was founded in 2012 – it dealt with debt management, and its bonds were offered by, among others Idea Bank. In July 2017, GetBack debuted on the Stock Exchange. In April 2018, due to the “interest and safety of trading participants”, the GPW suspended the trade in the company's shares and bonds.
In April 2022, UOKiK decided that GetBack used unfair practices when offering and selling corporate bonds, and its representatives misled consumers.
The PFSA has been supervising the banking sectors, capital, insurance, retirement market, supervision of payment institutions and payment services offices, electronic money institutions and the Cooperative Kas Sector since 2006.
