Amendment to the e-Contract Act. Electronic contracts not only for small companies


The project prepared by the Ministry of Family, Labor and Social Policy (MRPiPS) assumes: expanding the functionality of the public Internet system, which is used to support, among others, employment contracts or mandate contracts.

Thanks to the changes, it will also be possible to enter contracts previously signed in paper form into the system, which will simplify formalities and save time.
Digitization of contracts on a large scale. New possibilities of the e-Agreement system
The e-Agreement system, which is a free platform operated by the Ministry of Labor and Social Policy, now allows you to conclude and service contracts entirely online – from signing, through making changes, to termination. It is accessed via public administration portals, such as praca.gov.pl or biznes.gov.pl.
After the amendment, the catalog of contracts available in the system will be expanded. In addition to employment contracts, mandate contracts and activation contracts (e.g. for nannies), it will be possible to conclude documents such as volunteering agreements, training contracts, non-competition agreements or agreements on joint financial responsibility.

— Thanks to the new regulations, every interested entity, regardless of the size of the company or the form of activity, will be able to use the system – emphasized in the government announcement.
Electronic handling of paper contracts
One of the most important elements of the amendment is the possibility of entering contracts previously concluded in paper form into the system. Electronic handling of such documents will allow you to prepare annexes, introduce changes to employment conditions or terminate the contract.
Documents signed using a trusted or personal signature will have the same legal force as those signed by hand.

Thanks to the system, employers will also be able to electronically confirm the presence of employees, report the start of remote work or deliver employment-related documents.
e-Contract system. Integration with public registers
Extension of system functionality The e-Agreement will also include deeper integration with other public institutions, such as the Social Insurance Institution, the National Tax Administration and the Central Registration and Information on Economic Activity..
Automatic downloading of data from public registers is intended to reduce the number of errors and speed up formal processes.

Despite the changes being introduced, the government assures that the traditional paper form of concluding contracts will remain available. The e-Agreement system is intended to be only an alternative solution for entities that decide to digitize their processes.
Implementation schedule
New regulations are to enter into force 14 days after their announcement in the Journal of Laws. But full implementation of the new system functionalities is planned for a maximum of three yearswhich results from the need to adapt the IT infrastructure.

The government emphasizes that the amendment to the act is an important step towards simplifying formalities and increasing administrative efficiency in Poland.
