The decision is the biggest defeat the second Trump administration has suffered at the conservative Supreme Court, which has repeatedly sided with the president over the past year in a series of emergency rulings on immigration, the firing of independent agency leaders and drastic cuts in government spending, CNN recalls.
The Supreme Court decided by a 6-3 vote that the tariffs exceeded the law. However, the court did not specify what should happen to the over $130 billion that has already been collected in customs duties.

Donald Trump will not be pleased. The Supreme Court has decided on tariffs
“The President grants himself extraordinary powers to unilaterally impose tariffs of unlimited amount, duration and scope,” Justice John Roberts wrote in his ruling. “In light of the scope, history, and constitutional context of this declared power, it must establish the express authority of Congress to exercise it.”
The Supreme Court found that the US president did not have the authority to impose tariffs under IEEPA. This act, previously used mainly to introduce sanctions, was the legal basis for most of the tariffs imposed by Trump, including 10 percent tariffs on goods from almost all countries in the world.

Donald Trump: We're screwed
According to CNN, which cites administration officials, Trump learned about the decision during a closed-to-the-press meeting with state governors and called it “shameful.” However, he assured that the White House has a “plan B.” IEEPA is not the only law giving the president the ability to impose tariffs. However, other paths – as Trump himself and his people admitted – are much slower and give the head of state narrower room for maneuver.
“If the Supreme Court rules against the United States of America in this national security case, WE ARE FUCKED!” Trump wrote in December.
