Prime Minister Ilie Bolojan announced on Wednesday evening that the special pensions for employees in the Ministry of Internal Affairs, in the Defense structures and in the National Security system will be regulated in March, after the Constitutional Court established that the Magistrates' Pensions Law is constitutional.

The Head of the Executive explained that the systems in which retirement is allowed at the ages of 50-52 52, must be corrected.

“I believe that in all systems that allow retirement at 50, 51, 52, when a person is in full physical and mental faculties, where the pension is as much as the salary, things must be corrected not only from the point of view of inequities, but also of the sustainability of the pension system and for a healthy economy“, said Ilie Bolojan, at Digi 24.

According to him, the Government intends that in March, according to the draft GEO on the administration, it will come up with draft laws that will regulate special pensions for MAI employees, for defense personnel and for those in the area of public order and national security.

If we do not raise the retirement age for these categories, in the coming years we will have no one to replace them when they retire. We propose that in March, as provided for in the draft GEO on the administration, we will come up with draft laws in this regard. It is about the employees of the MAI, the defense area, the area of public order and national security”, said the prime minister.

The Prime Minister emphasized that there are differences between the categories of employees. In the case of those who carry out activities with special physical demands, such as paratroopers or front-line gendarmes, retirement will be earlier.

“There are situations where the physical demands are related to some difficult working conditions, such as paratroopers, front-line gendarmes, who must benefit from a faster retirement, and there are situations when you can work until the age of 65, if you work in the office area for example”, stated the head of the Executive.

On the other hand, for office workers there is the possibility to remain active until the age of 65. The systems that will be implemented will be discussed with specialists from the ministries, and each year worked in difficult conditions will be rewarded with additional bonuses.

The Prime Minister stated that the retirement age between 48 and 52 years can no longer be supported, and the pension equal to the last salary is no longer sustainable.

“The retirement age of 48, 52 years can no longer be supported. The pension of the last salary can no longer be supported. A transitional period is needed so that those who are of retirement age can benefit from the same conditions, so that an exodus does not take place. Just like in the justice system, where the transition period was ensured, it seems normal and common sense to me that in these systems, in order not to have disconnections, they can benefit from the conditions of the current law those who meet the retirement conditions”, said Bolojan.

Regarding the sum of pension and salary, Bolojan explained that the project prepared by the Government will allow employees to benefit from only 15% of the pension value, similar to the system applied to magistrates.

The government is to change, within 30 days at most from the entry into force of the emergency ordinance on the reform of the administration, Law no. 223/2015 on state military pensions. According to the decision-making transparency document, the standard retirement age for the military will increase in stages and progressively, reaching 65 years in 2034. The increase will be made gradually, every year.

The changes will be proposed by the Ministry of National Defense and the Ministry of Internal Affairs. “In order to apply the provisions of paragraph (1), within a maximum of 30 days from the entry into force of this emergency ordinance, the Government will approve, upon the proposal of the Ministry of National Defense and the Ministry of Internal Affairs, the amendment and addition of Law No. 223/2015 on state military pensions, with subsequent amendments and additions, in order to gradually and progressively increase the standard retirement age, with the application of transitional measures and without affecting the persons who meet the legal conditions for obtaining a service pension on the date of adoption of the normative act”the document states.

The draft Emergency Ordinance on the reform of the administration was published on Wednesday by the Ministry of Development, in decisional transparency, in the form agreed by the Coalition.

The document also includes other measures, such as a 100% tax increase for buildings built without a permit for a period of five years, as well as the publication of lists of taxpayers without arrears. In order to reduce public expenses, the project provides for the limitation of salaries in the institutions subordinate to the ministry, the reduction by 30% of the maximum number of positions at the level of administrative-territorial units and the elimination of 6,102 positions of personal advisers.
