As reported by Reuters, the source of the investigation is the company's controversial diversity policy (DEI). Activities that were supposed to increase the representation of minority groups, in this case, were supposed to lead to favoring selected groups at the expense of others.
The key point of contention is Nike's refusal to provide full personnel records. According to the EEOC, the company did not provide detailed data on the racial and ethnic makeup of its workforce. Investigators also demand lists of employees qualified for internal mentoring and development programs.
As part of these programs, selected employees receive additional support – for example, care from more experienced colleagues, training or accelerated promotion paths. This is intended to develop competences and prepare employees to take on more responsible functions.

The EEOC emphasizes that obtaining the missing information is necessary to determine whether a company's human resources policies violated applicable federal law.
