Authorities in Fulton County in Georgia on Wednesday questioned the legality of the FBI's seizure of ballots used in the 2020 presidential election. The FBI seized the documents as part of an investigation into alleged fraud in the election, which – according to US President Donald Trump – was rigged.

The FBI searched the county elections office last week, including: much of Atlanta. Officers confiscated paper ballots and voting machine tapes used in 2020.

We have filed a motion in federal court for the Northern District of Georgia seeking the return of all these materials and disclosure of documents related to the search warrant, Fulton County authorities said Wednesday.

The 2020 US presidential election was won by Democrat Joe Biden, defeating Trump, who held the office from 2017-21. Trump won re-election and returned to power in 2025.

Trump challenged the results of the 2020 election, making numerous accusations of mass fraud that have not yet been substantiated by any court ruling. Federal prosecutors during the Biden administration, in turn, accused Trump of conspiracy and illegal actions to reverse the election results.

In 2020, Biden won Georgia, but his advantage was only a few thousand out of about 5 million votes.

The FBI raid on the Fulton County elections office is another in a series of actions by the Trump administration using the Justice Department to get involved in matters in which the president has a personal interest, commented Reuters.

On Monday, Trump said that federal authorities should take over organizing the general elections scheduled for this fall in states run by Democrats. Republican leaders in Congress later distanced themselves from this statement. White House spokeswoman Karoline Leavitt softened the president's words. She explained that his intention was not to take over the management of the electoral process from the state authorities, but to tighten the regulations regarding the documents that voters must present before voting.
