Bailiffs helped a Krasnoyarsk resident resolve a family conflict and achieve redevelopment in the house. The GUFSSP of Russia for the region spoke about this.
A conflict broke out between a nephew and his elderly uncle over the layout of a living space on the right bank: they live in a two-flat house and are neighbors. An elderly man blocked the doorways leading to adjacent rooms on the side of his home, which is why his nephew could not get into the two rooms he owned. These premises have been empty for several years, and the legal owner did not have access to them.
Having considered the case materials, the court sided with the nephew and allowed him to carry out the redevelopment at his own expense. The man needed to make a new doorway to gain access to the rest of the living space through the spare room. However, the uncle categorically refused to let in the relative himself and the workers he hired to carry out the redevelopment.
“In order to restore the rights of the claimant and induce the debtor uncle to fulfill the demands of the court, the bailiff appointed an enforcement fee in the amount of 5 thousand rubles, and he also repeatedly brought the man to administrative responsibility under Art. 17.15 Code of Administrative Offenses of the Russian Federation. Constant monitoring by the bailiff and the prospect of new fines forced the debtor to stop obstructing the work,” the GUFSSP reported.
Today, construction work on the semi-detached house is completely completed: workers have made new doorways and reinforced them with angle steel. The nephew was able to restore the integrity of his home, the enforcement proceedings were completed with actual execution.
