The head of the Bucharest Court of Appeal, surprised by the statements of her colleague, judge Raluca Moroșanu: “Your reaction, I confess, shocked me”

CAB president, Liana Arsenie, said that she was “shocked” by the public statements of judge Raluca Moroșanu in the interview for the Recorder and that they were “tendential and devoid of truth”.

The president of the Bucharest Court of Appeal (CAB), Liana Arsenie, said on Wednesday, January 14, at Euronews Romania, that the public intervention of judge Raluca Moroșanu in an interview for Recorder surprised her “extremely unpleasantly” and was, in her opinion, “obviously tendentious and devoid of any trace of truth”.
“As far as Mrs. Judge Moroșanu is concerned, she was a colleague of mine and her reaction, I confess, shocked me, surprised me extremely unpleasantly because the statements were obviously tendentious and devoid of any trace of truth”. said Liana Arsenie.
In the context in which Raluca Moroșanu was Liana Arsenie's colleague in the court panel for a year, the head of CAB emphasized that the judge's reaction was all the more surprising since, during that period, there were no conflicts or professional differences between them.
“We were colleagues, I think for a year, during which we did not have even a disagreement, not even a discussion, in the sense that I want to defend criminals or that I am gentle with criminals. She was also my deputy, because at that time I was the president of the First Criminal Division and she was my deputy, for the position of president.” she explained.
Liana Arsenie also expressed her bewilderment regarding the way in which the judge expressed her grievances, emphasizing that they could have been addressed directly, in an institutional setting.
“Does anyone think that a judge can't go to a former panel colleague and tell him: Madam President, Liana, as he would have liked, there are some things I don't agree with. On the other hand, how can we believe that a judge (…) who can write a sentencing decision for 15-20 years, doesn't have the ability to tell a colleague, even if he exercises a leadership position, that he doesn't agree with certain measures?”, said Liana Arsenie.
At the same time, the president of the Bucharest Court of Appeal warned about the effects of the generalization of accusations against magistrates, which could seriously affect the public's confidence in justice.
“An anathema is placed on this professional body and I do not agree. Out of respect for my colleagues, I say that judges are assumed persons, mature persons. We cannot make such statements because we discredit the professional body. The moment the litigant no longer trusts that the judicial decision is based on reasoning based on the law, but on fear, the rule of law fails.” concluded Liana Arsenie.
