On January 1, the provisions on the recalculation of the amounts of pensions granted or recalculated in June in the years 2009–2019, as well as survivors' pensions of persons who received such benefits, entered into force. ZUS will calculate them automatically, which means that you do not need to submit applications.
Why does ZUS have to recalculate pensions?
The need to recalculate pensions awarded in June in the years 2009–2019 resulted from the fact that when determining the amount of the pension in June, the regulations at that time did not provide for taking into account additional quarterly indexation, but only annual indexation. As a result, retirees who retired in June could have their benefits even several hundred zlotys lower. This problem was drawn by, among others, Constitutional Tribunal.
Pursuant to the Act on determining the amount of pensions from the Social Insurance Fund determined in June in the years 2009–2019 and survivors' pensions of insured persons whose pensions were determined in June in the years 2009–2019, ZUS will re-establish the amount of the benefit without the need to submit an application.
If someone retired in June, the amount of the pension will be determined as if they had retired in May of a given year. The amounts of retirement and survivors' benefits determined in this way will be subject to indexation on the terms that were in force after the date of granting the pension or survivor's pension. The new amount of the benefit cannot be lower than the one paid so far.
ZUS gets to work
Benefits in the new amount are paid from January 1. ZUS has until the end of March to determine the new amount of the pension or survivor's pension.
The Ministry of Family, Labor and Social Policy announced that the regulations will cover approximately 103,000. people (95.5 thousand people receiving pensions and 8 thousand people receiving survivors' pensions), and the estimated average increase will amount to approximately PLN 220.
ZUS recently referred to cases in which retirees, despite the fact that the conversion of the so-called June pensions will be automatic, they submitted applications in this matter.
The Institute explained that if such an application was submitted before January 1, 2026 and on that date the proceedings to consider this application are pending or the case to determine the right to these benefits or their amount is pending before the court, ZUS will suspend the proceedings to determine the amount of the old-age or survivor's pension provided for in the new Act. The plant will be returned to him when the earlier proceedings are finally concluded.
If ZUS has been conducting proceedings regarding the amount of the benefit in connection with determining the pension since June of a given year or such proceedings are pending in court and started before January 1, 2026, they will continue until the final decision or court ruling becomes final.
