PNL MP Alexandru Muraru claims that Sunday's situation at the Constitutional Court of Romania (CCR), where the decision on magistrates' pensions was postponed, “raises a major question mark on the ability of a fundamental institution to exercise its powers”.

The CCR set a new meeting for tomorrow, and HotNews sources say that Sunday's meeting ended due to lack of quorum, as the four judges proposed by the PSD left the meeting room and did not return.

“The reform of special pensions is only the framework. The real stake is different: can the Constitutional Court avoid a deliberation that must be decided by vote, invoking non-participation? If it is confirmed that the lack of quorum was the result of deliberate withdrawals, although there was the possibility of forming a majority, we are no longer talking about a procedural issue. We are talking about an intentional blockage, with direct effects on the legislative process and on public trust in the state”, declared Alexandru Muraru, on Sunday, evening on Facebook.

He said CCR judges should “be benchmarks of integrity and accountability.”

“A state of law does not work on the principle of 'avoiding the vote to avoid the decision.' We cannot run endlessly from responsibility through procedural artifices. Justice cannot function on the basis of strategic absence and institutions cannot be turned into hostages of their own members,” he added.

CCR judges, he continued, “were not sent there to dodge difficult decisions.”

“The mandate of the CCR does not mean representation, negotiation or the protection of professional interests, but constitutional responsibility. The law must be validated or rejected by legal arguments, not neutralized by inaction. Any other approach turns the constitutional procedure into an exercise in avoiding responsibility,” Muraru said.

“If the decision of the CCR will continue to appear as a public defiance or if it will lead to the rejection of the draft law on magistrates' pensions, the political cost will be paid in full. The degree of public tension is already at a critical level. Therefore, a decision is mandatory. Not for a government, not for a party, not for a professional category, but for all Romanians who still believe in justice and honesty”, concluded Alexandru Muraru.
