Cristi Danileț, vehement criticism of the CSM:

Former judge Cristi Danileț contests the attitude of the section of judges of the Superior Council of the Magistracy (CSM), which warned that it “will not tolerate” interference in the activity of the judiciary, after the proposal of President Nicușor Dan to hold a referendum among the magistrates.

After the CSM representatives clearly rejected the initiative of a referendum in the Justice, former judge Cristi Danileț said, in a reaction on Facebook, Sunday evening: “I am interested in the proposals of the magistrates and the warnings regarding the abuses in the system. Especially those that will be revealed tomorrow.”

“When you have magistrates terrorized in the courts and prosecutor's offices, magistrates who are afraid to meet even with the President of Romania, when you have magistrates who post on internal discussion forums as “anonymous members” out of fear, when you have magistrates who are ashamed or embarrassed to say in private situations where they work, it means that the CSM has misdirected itself. Magistrates are not and do not feel protected”, says Danileț.

According to him, “8 out of 9 members of the judges' division have no idea what happens in the courts.”

“Although they have been in office for 2 years, only this week they launched a consultation through an electronic questionnaire among the judges to find out the problems. They mocked the Recorder material. They made fun of the magistrates who signed the list of support for the vocal ones. They lost Beșu by handing him over to the prosecutor's office and had no say in the abuse of Raluca Moroșanu with that laughable recusal. They sanctioned her Panioglu 5 times illegally”, accuses Cristi Danileț.

“They posted people to various institutions, although they complain that the courts don't have people (how the hell can you keep a magistrate seconded for 15 years in the SCM, and another through the Ministry of Foreign Affairs, today as an ambassador, for over 20 years??). They transferred people with good eyes. They promoted judges from their interest group to the top. They have a member in the SCM who is an agent of the Government. I support Savonea at the ÊCCJ, the one who was proven to have violated human rights,” he continues.

“Honestly, why would we tolerate the 8 there anymore? They do nothing for justice, but it seems they do everything for injustice,” concludes the former judge.

Cristi Danileț won at the ECHR after being sanctioned for posts on Facebook

At the beginning of this week, through a final decision, the European Court of Human Rights (ECtHR) condemned Romania for violating the freedom of expression of former judge Cristi Danileț.

An ECHR decision that comes at an extremely delicate moment in Romanian justice, after the Recorder documentary that divided the judicial system. Almost 900 magistrates, including Cristi Danileț, signed a common call for solidarity with their colleagues who testified in the documentary “Captured Justice”, while the managements of the Court of Appeal, CSM and ÎCCJ accused a plan to discredit and destabilize the judiciary.

The decision of the ECtHR is also important in the context of dozens of disciplinary investigation files initiated by the Judicial Inspection (which operates within the SCM) for the crime of opinion in the case of some magistrates who over time have signaled the problems in the judiciary.
