A resident of Krasnoyarsk was forced to buy a blush that she opened in a store, mistaking it for a tester. The story was told in Rospotrebnadzor.
Representatives of the department noted that the testers are visually different from the goods for sale. They are not marked in the Honest Mark system and are often marked “tester” and/or “not for sale.”
If the product packaging does not directly indicate that it is a sample, you should not open it and use the product. It is better to contact a store employee and ask for a sample of the product.
“According to the law, the seller does not have the right to force the consumer to purchase any product out of court. At the same time, if, due to unauthorized opening of a product or its use as a sample, it is no longer suitable for further sale, the seller has the right to demand that the consumer compensate for the damage caused to him (for example, by purchasing such a product by the consumer). At failure to achieve consent voluntarily, the dispute is subject to resolution in court», — noted in the press service.
