The Legislative Assembly of the Krasnoyarsk Territory discussed changes to the law on preferential purchase of land

The Legislative Assembly of the Krasnoyarsk Territory hosted a meeting of the Coordination Council of the Association for the interaction of representative bodies of state power and local government of the Krasnoyarsk Territory. It discussed the issue of the cost of selling land plots in state and municipal ownership and plots for which ownership is not demarcated.
The work was attended by the Chairman of the Committee on Natural Resources and Ecology, the head of the section of the Coordination Council Vitaly Drozdov, deputies of parliament Ekaterina Udelko, Vladimir Chernyshenko, Irina Ivanova, Alexey Kulesh, First Deputy Minister of Finance Pavel Kirsanov, head of the agency for managing regional state property Valentin Werner, as well as representatives of the prosecutor's office and local government bodies.
According to the regional law on the regulation of land relations for owners of residential buildings, garden houses or garages built on acquired land plots, the purchase price of land is 2.5% of its cadastral value. For other owners of buildings, structures and structures, this figure is 15%.
In 2022, a deputy commission carried out work to assess the efficiency of using land plots in Krasnoyarsk. With the participation of the regional prosecutor's office, several dozen cases were identified when good plots of land in the city center were purchased at an extremely low cost.
Deputies developed and adopted in the first reading a draft law, according to which it was proposed to sell plots of land only commensurate with the objects on them. Secondly, it was proposed to increase the cost of purchasing land for commercial purposes. Before preparing for the second reading, parliamentarians decided to update the agenda and consult with municipalities.
The heads and representatives of the administrations of Krasnoyarsk, Divnogorsk, Sosnovoborsk, Achinsk, Kansk, Taimyr, and Norilsk spoke at the council. In particular, representatives of the northern territories raised another issue – granting subsoil users permission to use land plots. Now this is done for free. Meanwhile, the number of such applications has increased significantly, for example, in Taimyr from 15 to 180 per year. A regulatory document is needed that will allow charging for this. It will significantly replenish local budgets. The prosecutor's office, in turn, suggested that when issuing permits for the sale of plots of land, administrations should always go to the site, and not make decisions only on documents.
“The current rule of law with a preferential price appeared when the construction market was just taking shape, and it was necessary to bring land into circulation. Since then the situation has changed, the law needs to be changed. The sale of plots of land of undemarcated property is a revenue stream for municipalities. Taking into account the new territorial structure, when Krasnoyarsk has significantly grown in borders, the boundaries of municipalities have changed, it is now important to amend the regional legislation in order to rationally manage these lands. So that they don’t go for nothing, so that there are no abuses,” said committee chairman Vitaly Drozdov.
This law will also help increase the revenue base of local budgets. Now the preferential sale of land brought only 120 million rubles, this amount will increase. Citizens who own a garage or house will not be affected. And large plots of land that are purchased for involvement in commercial activities will be sold at a fair price.
