Trade union organizations operating in Jastrzębska Spółka Węglowa (JSW) announced on Friday that they had initiated a collective dispute with the company's management. They do not agree with the decision to limit the payment of the Miner's Day award and the St. Barbara's Day equivalent for 2025 to 30%. due benefits.


“A collective dispute is inevitable. The Barbórka Award was not paid in full due to limited financial possibilities – this is, of course, the translation of the company's Management Board. Let's get ready for a longer fight for our remuneration and future,” representatives of the JSW Federation of Miners' Trade Unions and the JSW Staff Trade Union wrote on Facebook.
They attached a photo of the letter submitted to the JSW law firm on Friday, in which they inform about the initiation of a collective dispute.
The dispute concerns “the unilateral decision of the management board of JSW SA to partially pay the Miner's Day bonus and the St. Patrick's Day equivalent for 2025,” they said.
They demand that this decision be immediately suspended and negotiations commenced under the Act on the resolution of collective disputes. They also demand an explanation of the legal basis for the decision made by the JSW management board.
Trade unionists added that employers were given three business days to respond and enter into negotiations.
“The lack of reaction from the management board will result in the dispute being considered initiatedwith the possibility of referring the subject of the dispute to mediation and further protest activities provided for by law,” they concluded.
A similar announcement was published by the company's NSZZ “Solidarność” organization, which also firmly opposes limiting the payment of the St. Barbara's Day award and announced the initiation of a collective dispute.
“We expect the changes to be withdrawn immediately and dialogue to begin – otherwise we will take further steps under the Collective Disputes Act,” said the members of this organization.
They expect that the management board will suspend its decision and pay the Miner's Day bonus and its equivalent in full. Trade unionists demand negotiations and full “decision-making and financial” documentation.
In the opinion of trade unionists, the decision of the JSW management board constitutes a violation of internal labor law, especially the collective agreement of March 2021, which obliges the employer to agree on the wage policy with trade unions.
The decision to limit Barbórka's payment to 30%. the management explains the company's liquidity situation. As written in Thursday's report, the management board, in connection with the implemented JSW business restructuring process, decided “to partially pay the Miner's Day bonus and the St. Barbara's Day equivalent for 2025.”
The company announced that a payment of 30% will be made to all eligible employees on December 3, 2025. due benefits, calculated individually for each employee.
JSW announced that the gross amount of the award and the equivalent to be paid on December 3, 2025 will be approximately PLN 100.79 million. Together with the employer's estimated overheads, the cost of this award and its equivalent will amount to approximately PLN 127.31 million.
“The remaining amount of the accrued benefits will be realized immediately after the company obtains sufficient financial resources to ensure its stabilization of current liquidity,” announced the JSW management board.
On Tuesday, the company announced that its net loss after three quarters of 2025 cumulatively reached PLN 2.9 billion. Sales revenues amounted to PLN 7 billion, and the EBITDA result was minus PLN 1.4 billion.
After the first half of this year JSW had a net loss of PLN 2.075 billion and a decrease in sales revenues by PLN 1.461 billion compared to the same period a year earlier (to PLN 4.715 billion). The market environment has the greatest negative impact on the results: deepening declines in coking coal and coke prices. (PAP)
