Ziobro before the State Tribunal? The Sejm received a letter from the prosecutor's office

The Prosecutor General notified the Speaker of the Sejm about the charges brought against Zbigniew Ziobro wz. with his performance as the head of the Ministry of Justice and the State University of Technology, the National Prosecutor's Office reported. According to the PK, the Sejm may decide to hold PiS MP Z. Ziobro constitutionally liable before the State Tribunal.

The spokeswoman for Prosecutor General Waldemar Żurek, prosecutor Anna Adamiak, said that he had provided Marshal Włodzimierz Czarzasty with information about the content of the decision to present MP “Zbigniew Z. with charges relating to 26 crimes related to his function as the Minister of Justice, Prosecutor General, member of the Council of Ministers”. Proc. Adamiak noted that the University of Gdańsk provided this information in fulfillment of its obligation under the Act on the State Tribunal.

According to the PK, “this notification may constitute the basis for the Sejm to consider whether the violations of law described in the decision to present charges may constitute a constitutional tort, and, consequently, whether there are grounds for potentially holding Zbigniew Z. constitutionally liable before the State Tribunal,” it was emphasized.

Proc. Adamiak noted that the decision to charge Zbigniew Ziobro with 26 crimes in connection with his functions as the head of the Ministry of Justice and the prosecutor general was possible after the Sejm adopted a resolution consenting to holding him criminally liable for the acts described in the prosecutor's motion. She added that so far this decision has not been announced to the PiS MP due to his stay in Hungary.

As she emphasized, in accordance with Art. 156 section 1 of the Constitution, “members of the Council of Ministers shall be constitutionally liable before the State Tribunal for violating the Constitution or laws in connection with the position they hold or within the scope of their office.”

The statement recalled that in the proceedings conducted by the Investigative Team No. 2 of the National Prosecutor's Office regarding irregularities in the activities of the Justice Fund, extensive evidence was collected “to justify the suspicion that Zbigniew Z. has committed 26 acts classified as exceeding his powers and failing to fulfill his duties as a public official.” As noted, these acts were allegedly related to the exercise of the competences of the head of the Ministry of Justice and the State University of Technology, including irregularities in the awarding and spending of grants from the Justice Fund, which were to result in the misappropriation of property in the amount of approximately PLN 143 million.

According to the PK, since the resolution of the Sejm on November 7, 2025 included the consent to bring Zbigniew Ziobro criminally liable as part of the criminal proceedings conducted by the Investigative Team No. 2 of the National Prosecutor's Office, the notification sent by the Prosecutor General to the Speaker of the Sejm “may constitute the basis for the Sejm of the Republic of Poland to consider whether the acts described in the decision to present allegations of violation of the law regarding the performance of the function of Minister Justice of the Prosecutor General, a member of the Council of Ministers, may meet the criteria of a constitutional tort.

“Consequently, the Sejm may assess whether there are grounds for potentially holding Zbigniew Z. constitutionally liable before the State Tribunal in accordance with Article 156(1) of the Constitution of the Republic of Poland,” we read in the statement.

According to the constitution, “the resolution on holding a member of the Council of Ministers accountable before the State Tribunal is adopted by the Sejm at the request of the President of the Republic of Poland or at least 115 deputies by a majority of 3/5 of the statutory number of deputies.”

On November 12, the prosecutor investigating abuses at the Justice Fund ordered property security for Zbigniew Ziobro. “Property security is intended to ensure the enforceability of future court judgments of a property nature, such as a fine, the obligation to compensate for damage, forfeiture, return of benefits, by preventing the suspect from disposing of, encumbering or hiding property,” noted Przemysław Nowak, spokesman for the PK.

On November 13, the National Prosecutor's Office submitted a request to the District Court for Warsaw-Mokotów to arrest Ziobro for three months. The court hearing in this case is scheduled for December 22.

In the investigation into irregularities in the Justice Fund, the prosecutor obtained evidence indicating reasonable suspicion that Ziobro had committed a total of 26 crimes. The charges that the prosecutor wants to present to the PiS MP include, among others: assembling and managing “an organized criminal group for a period of five years, as well as setting up and manually controlling competitions for grants from the Justice Fund and appropriating money obtained in this way.”

The Sejm waived Ziobro's immunity on November 7 in relation to all 26 charges that the prosecutor's office wants to bring against him in connection with the Justice Fund case. The Sejm also consented to his detention and arrest.

Ziobro, who is staying in Budapest, has not clearly declared that he will apply for political asylum in Hungary or that he will return to Poland. – I intend to defend myself, I intend to use words, I intend to use the truth – he emphasized in one of the interviews. He also added that the time will come to clarify “each of these allegations, because there is nothing to hide.” Ziobro also said that the request for his arrest was “pure revenge by Tusk for the investigations revealing gigantic theft in his entourage.” (PAP)
