An association asked the CCR to declare unconstitutional an article of the law that covers the allowance for twins, triplets and multiples

The Association of Large Families asked the Constitutional Court to find the unconstitutionality of an article of law and to reaffirm the principle that every child, including those from twin or multiple pregnancies, has the right to the same level of social protection, regardless of the order or time of birth.

The Constitutional Court of Romania postponed until November 25, 2025 the pronouncement of the decision regarding the unconstitutionality exception of Article 5 of GEO no. 111/2010 regarding leave and child-rearing allowance, amended by GEO no. 164/2022, it is stated in a press release of the association, News writes.
According to the current form of the law, parents who give birth to twins, triplets or multiples receive a full allowance only for the first child, and for the other children only half of the amount (50%).
In the opinion of the representatives of the association, this formula “unfair” means that a family with twins receives, on average, 25% less support than a family with two children born a year apart — even though the expenses are double and occur simultaneously.
In 2024, 1,551 twin children were born in Romania, of which 775 are discriminated against even by law, receiving a reduced allowance just because they were born on the same day.
“Families with twins or triplets do not ask for privileges, but justice. Two children born two minutes apart cannot have different rights”said Mihaela Mosora, vice-president of the Association of Large Families.
This association is the only non-governmental structure in Romania that promotes, supports and represents the interests of families with three or more children. Association members are families with three or more children, “discussion partners” which “I understand very well the realities of educating, raising and caring for at least three children”.
