Interest rates are falling, so the cost of the most expensive loans must also fall. This is the result of the limit embedded in Polish law, which applies to banks, loan companies, but also private lenders.

Hardly anyone today remembers that just over 4 years ago, the most expensive credit card on the market was associated with interest of… 7.2%. Such rates may now be associated with mortgage loans, although fortunately for borrowers, “six” is the most common price list today. However, many cash loans still have double-digit interest rates.

In the market of loans and credits “for consumption”, the limits set out in the Civil Code and the Consumer Credit Act play a special role. The current upper limit of interest is twice the reference rate (after the November reduction in 2025 – 4.25 percent) increased by 3.5 percentage points. Right now the maximum interest rate is 15.5 percent.

How much interest for the loan? This is the maximum

Interest limit is the same whether you borrow from a bank or from a friend. The examples shown in the table illustrate the maximum interest that can be charged for various amounts and periods, assuming a one-time loan repayment. This limit applies to both financial institutions and private individuals granting loans unprofessionallye.g. among friends.

In the case of an annual commitment of PLN 50,000. PLN before the November interest rate reduction, the cost of the loan could amount to a maximum of PLN 8,000. zloty. The latest decision of the Monetary Policy Council resulted in a slight reduction of this limit – by PLN 250. However, it is worth noting that interest is not always a key component of the total cost of many financial products.

Fees and commissions are also a cost. Banks and lending companies must guard this border

The total cost of the loan includes both interest and non-interest costs, such as fees and commissions charged regardless of the principal interest rate. These costs are limited, but different regulations apply to them depending on the nature of the loan: different rules apply to consumer loans granted by banks, credit unions or lending institutions to consumers, and different rules apply to private loans between individuals.

Let's look at the provisions of the Consumer Credit Act. For loans and advances with a repayment period of at least 30 days, the limit for non-interest costs is:

  • 10% of the amount made available,
  • plus 10% of this amount for each year of the contract.

However, the total sum of fees and commissions cannot exceed 45% of the consumer loan amount, which means that further extension of the repayment period does not increase this limit. For the so-called “payday loans”, i.e. loans with a repayment period of up to 30 days, have a limit of 5% of the borrowed amount.

The table shows the maximum total cost (both interest and non-interest) at the current level of interest rates (4.25%) and applicable limits on fees and commissions. It is worth emphasizing significant differences in limits for commitment periods, e.g. 15 and 31 days. The more than doubling of the permitted maximum amount is due to application different thresholds for short-term and longer-term loans. The strict restriction on “payday loans” resulted in the almost complete elimination of such products from the market.

Loan between individuals – what is the maximum cost?

For private loans, the total maximum cost is slightly different than for a consumer loan. The total amount of non-interest costs “in a cash loan agreement concluded with a natural person and not directly related to that person's business or professional activity” may not exceed the rate calculated according to the formula: (number of repayment days / number of days in a year) x total loan amount x 20 percent.

The Civil Code indicates that during the entire repayment period non-interest costs cannot exceed 25%. total loan amount. This is the final limit, independent of the formula indicated above. Therefore, if we borrow money from our family for several years, this limitation should be taken into account.
