After the crowns were installed, the woman began to experience severe pain, which was temporarily relieved only by injections in the same clinic. Dissatisfied with the result of the treatment, the patient went to Krasnoyarsk dentistry, where she was diagnosed with pulpitis and caries.
The forensic medical examination encountered a problem: due to improper maintenance of medical records in the Kan clinic, experts were unable to establish a cause-and-effect relationship between the treatment and subsequent complications.
The court partially satisfied the plaintiff's demands, collecting the cost of poor-quality services, compensation for moral damage and a fine. At the same time, reimbursement of 200 thousand rubles spent on treatment in another clinic was refused, since the prosecution could not prove that these services were aimed solely at eliminating the deficiencies in the defendant’s work.
The court found that the clinic violated the criteria for the quality of medical care by not reflecting in the documents the diagnosis and condition of the patient upon treatment.
