A wave of layoffs and what then? “We don't go to such a meeting on a whim”


The registered unemployment rate in September was 5.6%. This is the fourth consecutive month with increases. By the end of September, employers reported their willingness to lay off over 88,000. employees.

Łodygowska, who was a guest of the “Onet Rano. Finansowo” program, pointed out that during group layoffs, we are often faced with much better terms of departure than in the case of traditional layoffs.
— For example: we have a mother who returns after maternity leave, is terminated for financial reasons, and her job is liquidated. Very often, she gets very good terms of leaving because the employer, in addition to giving her notice, can offer her better terms – for example, an additional one, two, three, four salaries, said the lawyer. And she added: – I have clients who receive 12 additional severance pays beyond what is guaranteed by law.
There is still a belief that a woman returning from maternity leave cannot be fired. The lawyer stressed that this was a myth – he could do it. — The Labor Code guarantees a return to the previously held position, but in the event of its liquidation, the employer is obliged to look for another position in the organization, she explained. In practice, however, it often turns out that this obligation is fiction.

The company wants to fire you? Get ready
Łodygowska emphasized that if we suspect or expect that we may be released, we should prepare. — When preparing for such a conversation, we do not go for the so-called trick. This is too serious a situation to leave to the employer, she said.
One way is to check whether the company is recruiting, even on its website. If so, you can use it. However, if the employer still does not want to keep us in the company, we have a stronger negotiating position and can win a higher severance pay.
If the company is still unsympathetic, the legal route remains. — Then such a case usually ends with either an appeal to court or me stepping in. I rarely wear white anymore, but I step in and we come to an agreement on the terms of my departure, he sums up.
