The Pegasus affair. Charges against the former deputy head of the CBA


The prosecutor from the investigative team no. 3 of the National Prosecutor's Office presented the case on Wednesday Daniel K., former deputy head of the Central Anti-Corruption Bureau, charged with exceeding his powers (Article 231 § 1 of the Penal Code) and disclosing to an unauthorized person information he obtained in connection with the performance of official duties (Article 266 § 2 of the Penal Code).
“The act alleged against the suspect is related to the actions of National Prosecutor Bogdan Święczkowski and Prosecutor Paweł Wilkoszewski, in respect of which requests for the waiver of immunities were submitted on September 30, 2025,” said Prosecutor Przemysław Nowak, spokesman for the National Prosecutor's Office.

“The allegation concerns in particular the transfer on July 8, 2020 to the National Prosecutor Bogdan Święczkowski of all the material (contained on 15 DVDs) obtained as part of the operational control carried out against lawyer Roman Giertych, including materials containing defense and attorney-client privilege” – pointed out prosecutor Przemysław Nowak.

As he emphasized, “the defense secret is covered by the so-called absolute prohibition of evidence. The material containing this secret should be destroyed immediately, in a commission and in accordance with the protocol. Its use in criminal proceedings is unacceptable (Article 178 of the Code of Criminal Procedure).”
The prosecutor's office reads that “the suspect did not have the authority to provide the National Prosecutor with materials containing defense and attorney-client privilege. “It was an act to the detriment of the public and private interests of a number of people whose right to keep information transmitted between the client and the lawyer confidential was violated.”.
Daniel K. was charged. He pleads not guilty
The prosecutor's office reported that Daniel K. was questioned as a suspect on Wednesday. He pleaded not guilty to the offense he was accused of and provided explanations.

“In this case, there was no need to secure the further course of the proceedings by applying preventive measures. The crime charged against the suspect is punishable by imprisonment for up to 3 years,” we read in the statement.
