FCSB, official measure after UEFA “moved” the Champions Cup to Steaua: “They are being misled!”

Ago changes made on the UEFA website regarding the track record of those from FCSBthe European Champions Cup and all the pre-2017 records being moved to the court of Stela Bucharest, the Romanian champion requested clarifications at the European forum.

These days, UEFA has made several changes to the official website. For the first league club, the European forum only displays matches played since 2017the year in which the company had to change its name to FCSB.

Furthermore, FCSB no longer appears as the holder of the European Champions Cup since 1986, the trophy being now awarded to Stela Bucharest, according to the final decision from the track record file.

The changes made by UEFA led the FCSB to request clarifications. In dialogue with GSP, the club's lawyer, Adrian Căvescu, stated:

“We have formulated and submitted a request for clarification to UEFA, now we are waiting for the answer. We are waiting for the answer and we will see [ce urmează]depending on the answer. Their decisions can be appealed, there are appeals.

They are either misled – and that's why I asked for clarification – or there is an unauthorized change of management. Surely it will be regulated. We don't know who reported it and we don't have any sense of injustice. We just want the truth, we want transparency.

I saw that a change has already appeared. In the clubs section, the final that appears is Barcelona – FCSB. Yesterday it was deleted, today it reappeared. Basically, they put back the current logo of the FCSB and acknowledged the association with the FCSB.

But UEFA cannot make such a decision without communicating to us as well. We have the right to defend ourselves! Someone notified UEFA – we don't know who, in any case Talpan – and the forum involved must take the position of both sides. No one communicated anything to us, so we said it was a site error, a wrong update, and asked for clarification. After the clarifications, we already see that this thing has appeared”.

What does it refer to? On the UEFA website, on the page dedicated to the 1985/1986 season of the European Champions Cup, although Steaua Bucharest appears as the winner (with the logo from that season), in the section of the clubs involved, FCSB appears, alongside Barcelona. But it is possible that the pages of the site will undergo further changes, as they have been for several days.

FCSB lawyer: “In front of football forums, continuity is what matters”

Next, the FCSB lawyer recalled the final resolution from the track record file and explained his own interpretation of it:

“What matters most to UEFA? Continuity, which is recognized by the High Court in the record process.

There, he said two things favorable to us: one, that CSA, after 1998, no longer has active procedural status, which means that it can no longer raise any claim on the subsequent track record, and two, he recognizes the sporting and competitive continuity ensured by us. But in front of football forums, continuity is what matters.

The decision from the records is favorable to us, from our point of view. We recognize this transformation, 47-98, 98-2003, 2003-present. It is logical.

But it is one thing to judge a court, which judged according to the rules of the civil procedure code regarding the transfer of property rights, like a plot of land, like a studio apartment, and they wanted documents, and another is the internal regulations of a national or international football court, for which continuity is relevant.

We have provided similar examples: Juventus, Chelsea and Rangers. All 3 went through the same situation of restructuring and transfer of ownership, and in all 3 cases, UEFA recognized the titles in favor of the successor, the current owner of the club.

UEFA has a jurisprudence in our favor and cannot decide differently now, that it wants an NGO from Romania. But we really don't know who reported it, nor is it relevant. In the end, we also want the truth”.

“How about writing a letter to NATO?”

The FCSB representative believes that CSA Steaua will never (again) privatize its football team so that it can move up to the first football league. We remind you that Steaua can play in European competitions and in the current form of organization, in case they win the Romanian Cup – the case of Corvinu Hunedoara is an example.

“That Steaua Bucharest does not exist at UEFA on the website, at the clubs. UEFA is an association of clubs. You cannot assign a title to an entity that is not a member of your association. It is illogical! They are not recognized, they are not members recognized by UEFA and they will never be!

This is because they are not of private law. And privatization will never be possible. Once because they don't want to, secondly because the Ministry will not find a legal solution, and 3rdly, because no one will come considering what happened.

In the Army, in the current situation we are in, football should not be a priority under any circumstances!

Look, doing evil is easy. Why should I write a letter to NATO now, in 10 minutes, to tell them: “Forget what the Romanians are spending their money on!”? But these would be evils that have no finality. We want to build, not destroy.

From my point of view, Mr. Talpan does not understand what the purposes of your actions are. Or is he only pursuing his personal interest, which he says in all the interviews”, believes Adrian Căvescu.

The club emphasizes that, according to the rulings of the Romanian courts, FCSB is the successor to the sporting and competitive activity of the team that won the trophy in 1986.

Over the years, the team went through legal and organizational transformations, but remained the same sports entity recognized by the Romanian Football Federation, the Professional Football League and UEFA.
