Ilie Bolojan no longer talks about resigning after the CCR decision. The Prime Minister says he will return with a new assumption of responsibility on the same project

The Constitutional Court admitted the objection of unconstitutionality formulated by the High Court of Cassation and Justice – United Sections and found that the Law for the amendment and completion of some normative acts in the field of service pensions as a whole is unconstitutional.

Prime Minister Ilie Bolojan had a first reaction on Monday evening after the decisions of the CCR earlier in the day, to declare unconstitutional the law on the special pensions of magistrates.

Bolojan no longer invokes his resignation in taking his position, but says that he will return with a new assumption of the Government's responsibility, but only after the 30-day period for the CSM's opinion has passed, a period requested by the CCR.

“I took note of the CCR's decision regarding the law on magistrates' pensions, established with a close majority of 5-4. The reform of magistrates' pensions remains a firm objective for the Government, assumed by the entire coalition. The CCR did not fundamentally reject the project of this reform, the objection was purely procedural, so the Government can resume the approach, which is a necessity. Nowhere in the world does it come out to the pension at 48-50 years old and a pension is not taken as long as the last salary. These are not political issues, but socially and budgetaryly unbearable privileges. Not the Government, not a politician or a party need this reform, but Romania needs it. We understand that the CCR has set a procedural standard regarding the length of time to wait for the CSM's advisory opinion. The government, through the Ministry of Labour, requested the approval CSM on August 22, and the Government's commitment to this project took place after 10 days, on September 1, a period of waiting for the CSM's advisory opinion that 4 of the CCR judges considered reasonable. Of course, the standard set by CCR will be respected”Bolojan wrote on his Facebook page.

The CCR specified in the justification that the lack of the CSM's opinion, combined with the Government's re-waiting for the entire 30-day period necessary to obtain it, violates art.1 para.(3) and (5) related to art.133 para.(1) and art.134 para.(4) of the Constitution.

And President Nicușor Dan promised to draft a new legislative text, which would correct an “abnormal provision – the pension equal to the salary – which the political class poorly regulated a few years ago”.
