Adrian Nica explains the statements regarding grandma's jam and the VAT GAP: “ANAF does not consider taxing the population's self-consumption”

The president of ANAF, Adrian Nica, came up with clarifications after the wave of reactions caused by the statement that “the jam that grandma makes at home is calculated at the VAT GAP”. Nica emphasizes that the institution does not intend to tax the population's self-consumption and that its statement was misinterpreted.

“ANAF does not consider the taxation of self-consumption of the population. By self-consumption is meant the use, by a household, of the products or services made by it for its own consumption”, stated Adrian Nica, in an official statement published on the institution's website.

The head of ANAF explains that his statement strictly referred to the methodology for calculating the VAT collection gap (VAT GAP) — an indicator that measures the difference between the potential VAT and the actual VAT collected at the budget.

According to him, “certain elements of self-consumption can distort the estimate of the potential VAT base, if they are not adjusted according to the national specifics”.

“We aim to carry out in-depth analyzes to improve the methodology for calculating the VAT gap, so that the results reflect the economic and social realities in Romania as faithfully as possible. Currently, certain elements of self-consumption can distort the estimate of the potential VAT base, if they are not adjusted according to the national specifics”. said Nica.

For a more precise estimate of the fiscal gap, ANAF announces technical collaborations with the National Institute of Statistics, the Ministry of Finance, the World Bank and European partners, with a view to methodological alignment and clear differentiation between evasion, non-compliance and statistical factors.

“Our attention remains focused on the real problems, and self-consumption will not be the subject of ANAF tax inspections. Although some interpretations in the public space confirm that not all interests converge towards ANAF's performance, my message is a clear one: ANAF continues the fight against the great evasion, with the same seriousness confirmed by our recent actions and results”. concluded the president of ANAF.
