The team of lawyers from Stoica & Asociaţii, consisting of Valeriu Stoica (Founding Partner), Victor Dobozi (Senior Partner) and Mihai Trandafir (Managing Associate), recently won an important victory for his client, associated with a group of companies in Brasov, in a criminal trial in which over 80 defendants were involved.
After a criminal trial carried out during over 10 years, characterized – during the criminal prosecution – through multiple violations of the procedural rights of the persons accused by DNA Brașov, during which several tax evasion offenses & the associates have been detained in the law, in the process, in the process.
Essentially, the illegality of the decision in the appeal was successfully invoked, which had established a sentence with 2 years in prison for two of the associates. Following the admission of the appeals in Cassation, a solution of final payment of the client was ordered.
The solution pronounced by the High Court of Cassation and Justice represents both a cessation of judicial abuses carried out in the last 10 years compared to the investigated persons, as well as a reaffirmation of the principles applicable to the criminal process – legality, loyalty and impartiality – principles from which no one can derogate, not even the criminal prosecution bodies.
